Hello, my friends. And welcome back to yet. Another episode of watching the Watchers live. My name is Robert Mueller. I am a criminal defense attorney here at the RNR law group in the always beautiful and sunny Scottsdale Arizona, where my team and I over the course of many years have represented thousands of good people facing criminal charges. And throughout our time in practice, we have seen a lot of problems with our justice system. I'm talking about misconduct involving the police. We've got prosecutors behaving poorly. We have judges not particularly interested in a little thing called justice. And it all starts with the politicians, the people at the top, the ones who write the rules and pass the laws that they expect you and me to follow, but sometimes have a little bit of difficulty doing so themselves. That's why we started this show called watching the watcher so that together with your help, we can shine that big, beautiful spotlight of accountability and transparency down upon our system with the hope of finding justice. And we're grateful that you are here in with us today because we've got a lot of news to get into. We're still talking about Afghanistan, probably going to be talking about Afghanistan for the next three years or so. So we're going to take a look at what's going on here. We had secretary of state Tony Blinken was out saying some things that the administration is doing. Then we have John Kirby over at the Pentagon Hussein, kind of some other things that the administration is doing. We've got two congresspeople who took a secret trip over to Kabul, and we're going to hear from them, see what they say, the conditions look like on the ground and all this. Meanwhile, the Politico website is reporting that the white house is a little bit upset with the media for not patting their back, giving them a bunch of accolades for this very well-executed withdrawal from Afghanistan. So a lot there in the Afghanistan segment, we're going to start off with the show, uh, right there. Then we're going to change gears, jump back into some COVID news because we've got more vaccine mandates that are coming out all across the United States of America. We're going to see what is happening with Delta. They're going to be charging their employees$200 a month. I think in a, I guess it's a non vaccination fee, something like that, kind of a new thing. So we're going to see what is taking place with that airline. We're going to go over to Oregon because the governor over there, a crazy person named Kate brown is now mandating masks if you're outside, even so not only inside but outside. So that's fun in Washington, just north of Oregon. We're going to take a look at a high school that is now putting ankle monitors on their students to track their COVID movements. So that's going to be fun. It's called the Triax proximity tracer ankle monitor. So that's actually been deployed in high schools in Washington state. Take a look at that. And then we, of course, we got to see what a defense secretary, Lloyd, Austin, the guy who double mast and put a face shield on. It's supposed to be sort of the, the tough guy of the DOD department of defense. He is now mandating vaccines for the entire DOD for all of the, uh, all the Pentagon, all DOD employees have to, uh, now get vaccinated. So we'll take a look at some of the stuff and actually review the, the memo that came out from the department of defense. So that's going to be fun. And then in our last segment, we're going to check back in on the Owen Shroyer case. Owen Shroyer was the info wars journalist who was up on stage near the white house with Alex Jones and some other people in the media. As we know, we talked about this earlier last week, he had to turn himself in on Monday because the FBI issued an arrest warrant for him, for being there on January 6th. And so he had court yesterday, have a little bit of an update on the case because there's something interesting going on here. The judge is asking the us attorney's office to say, Hey, what's your policy with regard to the people in the media with regard to journalists, it sounds like you just sort of arrested this guy, but there were other journalists who were covering the media. Why were they not arrested? Do you have a consistent policy as it relates to members of the media? Because now we have competing interests. Don't we we've got the right to protest and free assembly. We've got the ability, the desire to protect the Capitol, to make sure that it's not inserted at any time. And you've also got this very important interest of journalists that are supposed to be reporting on these things. And he is kind of in that, in that area, right? He's with Alex Jones, part of info wars, which you know, used to be this organization that people scoffed at, it turns out they had been right, most of the time on a lot of different things that are happening these days. So we're going to take a look at a lot of different stories. Isn't that nice? All right. So enough of that, let's get into the news of the day, Afghanistan, Joe Biden in the Biden administration. They're still trying to sort of tease this thing out. Kind of draw out the meat sauce from the meat balls, from the spaghetti, it's all a big mess. And they're trying to sort of figure out how to unpack all of this. And so one of the biggest questions we've been having here has been about the total number of Americans that are still stranded, or if you're gen Saki, not stranded in Afghanistan, we've talked about the three different layers of analysis here. The idea that, well, you can have a, an agreement or disagreement about the original decision to leave Afghanistan. You could have another disagreement. It's a whole separate issue about the mechanism of leaving Afghanistan. That's kind of layer two. And then the response to the leaving of Afghanistan, that's layer three, the response to the botched with, and you want to measure that leadership on its own pedestal to somebody. I agree. And so we've been watching what the Biden administration has been doing. Largely acknowledging that leaving Afghanistan was a good decision, right? It's something that many people in America want to have happen. The question has been about the mechanism and then in response, the leadership to the problematic withdrawal. So the biggest question that I've had in many people have had is how many Americans are still over there? How many people we know August 31st is coming up here pretty soon, like really soon. And we need to know how many additional Americans should be evacuated out of there. And the administration has been very, very sketchy with this number. We've been trying to pin them down on it as have many people in the media to say, Hey, how many are in that bucket? They come out every day with new numbers. Oh, we, we moved a 6,000 people. We moved 4,000 people. We moved 2000 people. That's great. That's really, really great. If the total's like 5,000 or 10,000 people, that means 2000 a day, we've got six days left. Okay. So that sounds like we might get everybody, but we don't know what that total number is. And so 2000 out of 40,000, that's not so good, especially if we've got six days left. And so now as it's basically time to pack up, right, you start packing up an operation like this before you have to leave. You don't just say, oh shoot, honey. It's, um, it's August 31st and checkouts at 11:00 AM. I guess we better pack up and get outta here. Huh? That's not how that works. Right? They've got a huge military operation is 5,500 soldiers or 6,000 soldiers, or however many that Biden had to send back in there. They all got to pack up and go. So the evacuation, the withdrawal is kind of already starting right now. And now it's getting very clear that we need to know how many Americans are going to be left over there. And so CNN was able to get a number out of secretary of state Anthony Blinken today saying approximately 1500 people who may be Americans don't even know are left in Afghanistan. He says, so he came out on Wednesday. It's at approximately 1500 people who may be Americans left and left in Afghanistan. Like as of, kind of today kind of now, and this pay attention, pay attention. Even though we have a number it's really hard to tell what this number is, is this the number of Americans who've been in contact with the secretary of state? Is this the number of Americans that we think are outstanding, that, that, that have not been in contact. There's all different categories. And they're trying to sort of paper over this number because it's a, it's a, it's a bad number and as much confusion as they can keep surrounding issue about how many Americans are left. Well, that, that, that serves them. We saw Jake Sullivan earlier in the week saying, well, it's kind of American's fault that they're still there. They could have left a long time ago. They came here. Maybe they should have left some time ago. And also sort of saying, it's hard to measure how many Americans are there in the first place. People go to Afghanistan. They don't tell us about it. People leave Afghanistan. They don't tell us about it. And so what was us the U S government, the people who plan for every contingency who are patting themselves on the back of this as a beautiful evacuation, uh, are flying in the dark. Well, we don't know. So now we're able to dial into a number. We've got 1500 people who may be Americans left in Afghanistan, don't know, adding that when evacuation operations began, there was a population of as many as 6,000 who wanted to leave blink and said that they have evacuated at least 4,500 Americans and likely more since August 14th, 500 evacuated in the last day

But not so sure that that's going to be possible because we don't know what the total number is. He said, quote, over the past 24 hours, we've been in direct contact with approximately 500 additional Americans and provided a specific instructions on how to get to

Remaining 1000 contacts. See that that we had, who may be American seeking to leave. We're aggressively reaching out to them multiple times a day through multiple channels of communication, which is that same stupid line that Jake Sullivan and Jen Saki were saying, this is

Tire week. Oh, look, don't tell them

Speaker 1:

The worst stranding Americans. Okay. We've been calling

Speaker 2:

Them and emailing them and text

Speaker 1:

Messaging them. Okay. Fox news. What else do you want me to do? Send a carrier pigeon over there. You know, sort of acting what was me like we've been doing everything we can humanly possible to reach these people in the middle of Afghanistan in the middle of a war zone. The Taliban have taken over. I wonder if their cell phone service is very good in a failed state where the infrastructure is crumbling around everybody. Maybe their wifi is down. I don't know, but the U S government is doing their best. And they're very frustrated that you're not acknowledging that. So it says here, you can see very carefully. This language is certainly, you know, interesting says of the roughly remaining, what is this 1000 contacts? I don't know what that means that we had, who may be Americans.

So it's just, uh, we're aggressively reaching out to them. Okay.

We really don't know what that means. 1000 context. So does that mean that those are the number of Americans who reached out saying, I want to get out of here. Yep. You said any American who wants to leave, wants to leave? That's me come get me. Is that that, or

Pickens that they suspect are still there that have not reached out as

Speaker 2:

Well? Probably not.

Speaker 1:

Right. This is probably the people that they said have reached out to us. So we'll be curious of what that means. 1000 contacts they reached out to you. You reached out to them because we're going to see here that the numbers don't exactly match. Do they? Jake Tapper earlier today, this was before Anthony Blinken spoke. So he posted this and then blink and came out and apparently corrected this number. But this is what he was hearing. He said in a briefing to staff, state departments at 4,100 American citizens are still actively seeking to get out of Afghanistan, set a Senate aid. Not all Americans are located in or around Kabul. The U S has evacuated approximately 4,400 already. And we saw numbers, right? We saw a big, broad spectrum of numbers from 10,000 to 40,000. Maybe more than that. And the administration up until today is not really given a clear number on that at all. Well, we don't really know. Jake Sullivan said, no, they don't register with us. So how can we possibly know? So Jake Tapper says there was congressional staff. Congressional staff reported this back to Jake Tapper over at CNN. And apparently the state department then came out and corrected that it wasn't 4,100. It was actually 1500 Americans who are still in contact with the state department per Anthony Blinken. So who knows, right? Who knows what the numbers are that the administration has been all over the place on a lot of this stuff Blinken said on Wednesday, it's hard to overstate the complexity and the danger of this effort. There's a very real possibility of an ISIS K attack. So we have an ISIS K, so we'll probably have a lot of those different variants as well. We've got a lot of COVID variants, ISIS, K you know, ISIS, uh, Delta ISOL, ISIS Lambda, whatever we've got were operating in a hostile environment. He said, and the city controlled by the Taliban with the very real possibility of an ISIS K attack. We're taking every precaution, but this is very high risk. He says, as the president said yesterday on track to complete our mission by August 31st provided the Taliban continues to cooperate. There was no disruption in this effort, meaning that the United States is sort of at the Beck and call of the Taliban provided they continue to cooperate if they don't. Well, the whole, the whole ball game changes because we have no leverage over there. He said, there is no deadline on our work to help any remaining American citizens who decide they want to leave to do so. That's a very unequivocal statement. There is no deadline on our work to help any remaining American citizens who decide they want to leave to do so. Along with many Afghans who stood by us over these many years and have continued and have been unable to do. So he says that effort will continue every day, past August 31st. See that I wanted to spend time on that because that's a pretty clear, it's pretty unequivocal. It says, look, this administration, the state department, we're going to do everything. We can no deadline. The effort's going to continue past August 31st. If you're an American, if you want to come home, you can come home. Just like Obama said, if you like your doctor, you can keep your doctor that didn't really work out. But in this case, they need it this time. This is the second version of that administration says. They mean it this time. If you want to come home, you can come home. We'll see if that happens. Now on Tuesday. It's very interesting because Blinken is saying that every effort is going to continue every day past August 31st, but then on Tuesday, one day yesterday, it said Biden confirmed that he's not going to extend the evacuation deadline beyond August 31st. So it literally from a CNN article, the exact next sentence says the opposite of that. President Joe Biden is acknowledging the growing threat and he's not going to extend the evacuation deadline beyond August 31st. So in the same article, you've got sort of a conflict there. You've got the secretary of state saying effort is going to continue everyday. Past August 31st, Joe Biden says, oh no, we're not going to extend the evacuation deadline because the deadline is August 31st. So it sounds like if you're an American and you want to get evacuated, the secretary of state says you're good after August 31st. If you're the president, not so much. So what's going on there. I wonder if there's somebody here who can break the tie between these two, because we have the secretary of state and the president, and there, they're not really in a uniformity here are we. So let's take a look at what the Pentagon has to say. Maybe they can break this tie. Here is John Kirby. RNC research said, we're going to evacuate people, Americans up until the end. That was his quote. Here it is. If

You're an evacuee that we can get out, we're going to continue to get, get you out right up until the end. But in those last couple of days, we're going to try to preserve as much capability as we can on the, on the, at the airport, as you might imagine. So in those last couple of days, uh, we will begin to prioritize military capabilities and military resources to, to move out.

Speaker 1:

Yeah. Yeah. So, so the Pentagon breaks, the tie, Joe Biden wins. You're not getting out after August 31st up until the end is what the Pentagon said. No, we're going to keep it. Look if we can get you out and you want to get out, we're going to get you out of there up until the end. But it's kind of like right now, because we have to start thinking about the withdrawal, actually getting the last airplanes up off the ground. Remember this is sort of like a world war Z movie where there's Zuora, uh, hoards of people that are sort of looking like zombies in a Hollywood movie, they're going to be crashing upon the runway. If the Taliban, according to this administration is not cooperative and keeping them at bay. So yeah, they've got a lot of work cut out for them and they need to start planning for that because they only have six days left. So, uh, it seems like maybe the focus is, is sort of shifting from saving Afghanis or from saving us American citizens and into transitioning away from there. All right. So let's see, uh, some confusion from the administration course. John Kirby says, now we're out of there. August 31st president Biden says, yeah, we're out of there. August 31st Blinken comes out. Nobody really knows what he's talking about. 4100 1500, who knows talking about the contacts that are being made. Nobody's asking about that. They're asking about American citizens who were still in Afghanistan, not whether you got a text message from them or not. That's great. If you did, you should count that that's a person who wants to get out of there. And so you should add that to your tally, but don't report back to the American people. Like this is a great thing. We've got a thousand contacts over there. You got six days left there by my man. Probably want to get on that. So, uh, we, we don't really know how things are going on the ground from this administration. They've been hiding the ball for a long time, but we fortunately have some congresspeople, a bipartisan unifying unity agreement. Look at these two guys. We've got a Democrat, Seth Moulton over here. He's in Massachusetts sixth district. Us house of representatives took office in 2015. We got a Republican Peter, my air over in Michigan's third district, both from M states. He's in the third district, took office on January 3rd. So he's a newbie. And he replaced Justin Amash, the libertarian, who was a sort of a strong anti Trumper. Now these two guys, former military, they went over to cobble. This was an unauthorized trip, which is causing a lot of, uh, uh, grief for the administration. They're unhappy about it. Washington examiner is telling us that this pair, they went there to members of Congress. We have democratic rep, Seth Moulton, Massachusetts Republican rep Peter, my air, Michigan. They made a secret unauthorized whirlwind trip over the cobble airport on Tuesday to see the chaotic situation. We have two congressmen were reportedly there for less than 24 hours. They traveled on their own time on a commercial plane to the UAE. Then on an empty military flight, then back out of cobble on a plane that had at least three empty seats to ensure there was extra capacity. Both members are veterans have been critical of president Biden's handling of the withdrawal molten who had a short-lived presidential bid in 2019 as a decorated combat vet. That's the Democrat. So he went over there. He served four tours in Iraq. My air was an army reserve intelligence specialist. He was also deployed to Iraq. So we've got two gentlemen over there who have some experience in combat situations, both in Iraq, specifically combat veteran, four tours, Iraq and other, another tour in Iraq. These two guys, the white house is not happy about this. A lot of unnamed officials were out there, you know, posting in the, uh, uh, I guess New York times or wherever I was reading this saying that this was totally responsible that these are, uh, you know, to, to people who are taking seats from other Afghans. And they're, you know, making a political show over a very troublesome situation and more bodies. There are just going to complicate things. And so they were very upset about that. Well, I can understand that. I've also seen several pictures. I don't think I clipped any of them for the show, unfortunately, of empty aircraft, leaving the Kabul airport, nobody on board because the state department is not processing people fast enough. We're going to get into that here in a little bit, but let's see what these two gentlemen reps molten and my ear had to say about their trip because they put out this press release from Washington. They say, as has been publicly reported, we recently went to Cabo to conduct an oversight on a mission to evacuate Americans after their departure. They issued the following statement. These two gentlemen, as veterans, we care deeply about the situation on the ground in cobble America has a moral obligation. We got to keep it like many veterans. We spent the last few weeks working without sleep to try to get as many people as possible home. As members of Congress, we have a duty to provide oversight over the executive branch. There's no place in the world right now where oversight matters more. We conducted this visit in secret. Speaking about it only after our departure to minimize the risk and the disruption to the people on the ground. And because we were there to gather information, not to grandstand, we left on a plane with empty seats, seated in crew, only sees to ensure nobody who needed a seat would lose one because of our presence. Washington should be ashamed of the position. We put our service members in, but they represent the best in America. These men and women have been run ragged and are still running strong. Their empathy and dedication to duty are truly inspiring. The acts of heroism make America proud. We came into this visit wanting like most veterans to push the president to extend the August 31st deadline. After talking with commanders on the ground and seeing the situation here. It is obvious that because we started the evacuation so late that no matter what we do, we won't get everyone out on time. Even by September 11th, sadly and frustratingly, getting our people out depends on maintaining the current bizarre relationship with the Taliban. His words, not mine. In coming days, we will have more to share with our colleagues in the American people about what we learned, but after meeting with Marine soldiers and everybody else, we want the world to know we've never been prouder to be American. So yeah. Very interesting point. The bizarre relationship with the Taliban. Totally. It is bizarre, right? It sort of just flipped like within a month from America's enemy, these, you know, fifth century cave, dwellers who stone women and execute people by beheading them. All of this stuff is insane. The way that they live and the way that they conduct themselves is reprehensible right. America. And so that's why we decided for the last 20 years to go out there and do something about it. And then suddenly, whoa, that's not how it is anymore. Now the Taliban might get a seat on the UN gender council or something like that. What? Yeah. So it is a bizarre relationship happened very interestingly, it, it happens quickly when your enemy wants everything they can get from you. And they have, I don't know, thousands of American hostages, no wonder they have really, really elevated their position pretty quickly. All right. So we are hearing from the two Congress people that it's not looking like all the Americans are gonna get out, get out of. There wouldn't even get out of there by nine 11, let alone August 31st, which is in six days from now. So a couple other notice notices here on Twitter as to why this is becoming so problematic. Why can they not get more people out more quickly while some of the problems are just coming right from the state department? Gareth brown said someone I'm close contact with made it to the gates of the Kabul airport last night after literally waiting through a sewage drain only to be told that they're now accepting us passport and green card holders. They were able to get the Afghans inside the airport. He said, but we're turned back by what he described as a state department checkpoint. Very, very interesting. Why is the state department turning around SIVs on August 24th? Hmm, interesting. Very curious. Sounds like this may not be the most, uh, impressive air evacuation effort that we've ever seen. Speaking of the sewage and the, uh, the situation outside of Afghanistan here is what Ian panel over on Twitter posted. It said devastating scenes at the Kabul airport. Knee-deep in sewage, waving their papers begging to be let in. You can see this right. Everybody's raising their papers. So now Tom Biden, officials and administration allies have begun, aggressively touting their success of their evacuation efforts. They framed the operation as historic in line with the Berlin airlift declared that they're quote over-performing their own metrics. And they've trumpeted the president, his quote, defying expectations. That's true. He is defining our expectations. Uh, that is true. Yeah. I mean, I thought he was going to be terrible, but I mean, wow. Even worse than I thought my expectations have been shattered. It startling 180 from a defensive crouch Biden and seem occupied just a few days ago. One that reflects the sense of combativeness that has emerged in the west wing as they sort through the first major sustained crisis. And while it sparked accusations that the president team is trying to divert attention away, bind defenders stress. Now for at least he deserves to Crow, a buoyed by evacuation numbers, aids and allies have gone from feeling beleaguered to galvanized, taken into social media in the airwaves to let out their grievances about the press coverage that they'd been harboring privately since the crisis began. And to make the case that the white house as accomplishments should get more credit and attention. They've noted the evacuation figures exceed the estimates. The administration put out. The U S could ask the Russians to play a mediating role in facilitating a clean U S exit. Russia would probably help too, as a clean us exit is in its interest, but it really does not want to an unstable Afghanistan with a bunch of refugees and terrorists flooding across its borders. Well, the U S asked the Russians for help. I doubt it. What would be much worse for the U S government than having to go cap hand into cap in hand to the Russians and Iran hostage crisis situation? And you had certain people like Mitch McConnell come out and say, well, just ignore the deadline. Just keep people there. If they start executing American hostages, which is what would happen then. So be it right. Then the U S has to go back in full force and take care of business, which would reopen the Afghanistan war, which a lot of people don't want to do. There's also conversations about Afghanistan, rebels sort of hold overs from the government who didn't hop on airplanes and flee the country or join the Taliban that are in a different part of the country. And you go and support them and sort of build a counter force to the Taliban to balance that out a little bit so that they at least know that there's somebody who's threatening their, their, their stranglehold work with other countries work with NATO allies, but they don't want to work with the U S because we just sort of abandoned them to a large degree and are not negotiating with them. Either Joe, they wanted to extend the deadline. Joe said no. So, uh, there's a lot to continue to play out. I think that it's probably going to be a mess. Any which way it goes. I don't think that it's salvageable at this point because it was such a blender on the front end. It's ed says, Hey Rob, imagine if BP said we are doing an amazing job cleaning up this oil spill, this is a historic moment. We are very proud considering they caused the problem. Unvaccinated employees are going to face other restrictions, including indoor masking effective immediately weekly COVID tests announced this policy for all airline employees, all of them measure as the latest attempt by U S corporation to do it. Delta self-insured its employees stands out and its plans to raise premiums for un-vaccinated workers to cover the higher costs. So this guy, age 64 lives in New York, born, born in New York, wherever. So, uh, he's the CEO. That's what he's doing. So we've sort of talked about this a lot. A lot of industries are trending this direction. We heard from a firefighter yesterday from the Los Angeles fire department who said, well, basically I've been here for 31 years. I'm a veteran, I'm a captain. And like other chiefs and other captains throughout this country, I don't want to get the job. And so if you mandate it, I have no choice, but to resign. And so we're, we're going to see if this happens. I've been saying for some time on this channel, that there is a slow resorting. People are self-selecting. It's like when you mix water and oil together and you shake it up, things get kind of mixed up and then it slowly separates that's happening right now in this country in super slow motion. People are drawing lines in the sand about what they're going to tolerate and what they're not going to tolerate. So we'll see what this does to those employment numbers. It may not change anything or it may change a lot. We'll see. So that is happening. It's also happening in fire departments in different localities. This is about the vaccine mandate. We have another psycho person whose name is governor Kate brown over from Oregon. And she posted this on Twitter today, says, uh, today we have a thousand COVID COVID patients in our hospitals. I'm continuing to take actions to protect Oregonians and to save their lives. So that's good. So she's a, like a godlike figure. She's saving lives good for her effective on 8 27, masks are now going to be required in public outdoor settings where physical distancing is not possible, regardless of vaccination status. So it's like insane on like multiple different levels. Number one, if you're vaccinated, well then what are you still wearing a mask for in the first place? Uh, okay, so that's fine if you want to do that. So your Vaxxed and unboxed mast up regardless, and this is not even indoors. This is outdoors. So if you want to go to the Oregon beach, if you want to go to the Oregon city fair or state fair or whatever they have, you got to put a mask on. If you want to go sit outside and have a picnic at a park or go on a playground, you're massed up in sunshine, getting exercise and fresh air where one might suspect you shouldn't be wearing a mask, but this savior of the Oregonians, the person who's going to protect you and save lives is now going to make you wear a mask everywhere you go. So as soon as you step outside of the house, and if you're in close proximity with anybody else, mask your face up, she's very heroic woman. Very proud of her. Let's see what else we've got here. Okay. So that's an Oregon. Now something must be going on in the Northwest part of the country because we have another psycho, uh, story. Washington school is blazed blasted for masking student athletes. I'm sorry, making student athletes wear ankle monitors so that they can be alerted if another player test positive for COVID. Okay. Now I'm a criminal defense attorney. We're familiar with ankle monitors. They typically put them on people charged with serious felonies to make sure they don't flee the country. And to make sure they don't go commit additional crimes or go engage in nefarious activities. But now a high school in Washington is putting them on student athletes. So this is called Eatonville high school receive backlash effort, implementing a measure, which student athletes have to wear ankle monitors, parents and social media said that these are used for offenders under house arrest there for criminals, not for children while both vaccinated and unvaccinated students and coaches are required to wear the monitor. Only unvaccinated individuals are required to quarantine. So they are literally branding their students in Eatonville. This school has refused that they are using trackers on students called the devices, proximity monitors instead. So that's cool. The monitor is only used during practice and then left at the school. All right, so they don't take it home. This is what it looks like. This is the proximity tracer says here in the time of COVID, how will you maintain safe working distances? So it looks like it's a little, almost like an apple watch looking device, meet our social distancing and tracing solution. Isn't this nice active feedback, visual and audible alarms, passive collection of worker interactions. The main device of the proximity trays called the trace tag. It's worn on the body or a fixed to a hard hat for proximity detection and contact tracing together. We're going to keep people safer by maintaining social distances. So it's not like a shock you, if you get too close to somebody, it says the system overview workers will be issued a trace tag to be a fixed to the front of the hard hat or on the body gateways for collecting close contact worker interactions are gonna be placed at exits and high traffic areas. Optional features real-time progression of audible visual alerts when workers are in close proximity. So it will actually alert you when you're getting too close to somebody else. Oh, what a joke? Close proximity interactions, including duration are recorded on the trace tag until it gains connectivity to the gateways, and then it uploads it to the cloud. So it just sort of monitors who you're bumping into. And then everything gets uploaded. Gateways are going to log attendance in a real-time general visibility of who was present at the site. They are literally tagging you. So almost like, you know, when you see the nature shows and they go out there and they're like, let's go get those a Buffalo. And they get the Buffalo and they take the Buffalo down, cowboy lasso is that up? All right. And then they go and they staple the thing to the ear and it's like, okay, that is Buffalo 37. Got it. And now we can track Buffalo 37 all over the place. That's you now that's us. That's us. That's us. That's our kids in high school, Eatonville high school. And so this is now rolling around everywhere, and it may not come in the form of something that you have to attach, but there's already apps for your phones. Of course, you know, your vaccine passport is now something that in many places in this country, San Francisco, New York city, to be specific soon to be many other places, you got to actually show them. And you might have the government officials, the little hall monitors out at your restaurants who are now scanning your barcode so that they can also just make sure, Hey, make sure that you're following rules. So we've got a lot of these Looney tunes out there trying to just, I guess, see, just kind of prying to everything that you're doing, including in high schools with kids. And so what, how did this happen? How do you have a high school that just says, we're just going to start tagging your children. Nobody had a problem with that. Well, they kind of did Eatonville yesterday, sent out this email or this the letter set us skews. Sorry about that. Eatonville families. We have received questions about the proximity monitors that some of our students have been tagged with that we've been stapling to their ankles. They say, oh, well, listen. Our core values of curiosity, excellence, responsibility, all of that are meant. We have good intentions. We want to create positive relationships. They tell us where this all started. We received grant funding known as E S S E R three. That specifically included provisions to support higher risk athletic programs. We'll use some of those funds to pay for the proximity monitors, where you're using this monitors for high contact and moderate indoor contact sports. The monitors are fo both for staff and coaches, regardless of whether they're vaccinated or not. They want to tightly determine who might need to quarantine. Same technology used by professional athletics. NFL is using it as well. The system prevents taking students out of school and athletics unnecessarily. It's a top priority for families and staff staff. The school year is going to bring numerous changes and the situations are going to be dynamic. So they got a grant known as ESS E R three. That specifically included provisions for athletic pro proximity sensors. Huh? Wonder where that funding came from. I wonder who paid for that? I wonder what their interests are. Having had a chance to take a look at that, but would it be a good research project? We have a more troubling news. Now the mandates continue to be mandated all around the country. We just heard that Oregon is now having mass mandates. We also have heard that, uh, different states and different cities have different vaccine mandates different passports. In fact that you can't even engage in society unless you are vaccinated. Well, now that is spreading beyond just those localities. It's also going into the federal government, also going into the U S military. The Pentagon is now ordering troops to get their vaccines ASAP. This was a sort of speculation in many parts of the country. But now since the FDA allegedly approved a Pfizer vaccine, a lot of conversation happening about, about that whole thing. We're not going to talk about it, but here, what you see is since the FDA has officially said that the vaccines have full approval, the military turned around and said, boom, that's exactly what we needed. Now it's mandatory. Military troops must immediately begin to get the COVID vaccine said, defense secretary, Lloyd, Austin. He said in a memo on Wednesday, we're going to read through it more than 800,000 service members have yet to get their shots. According to Pentagon data it's a lot of people wonder why they don't want to get it. Now that the Pfizer vaccine has received full approval from the FDA. DOD is adding it to its list. Austin memo does not dictate a specific timeline for completing the vaccines, but it says that they have to report regularly on their progress. A senior defense official said that Austin has made it clear. He expects them to move quickly. This will be completed in weeks, not months. So, uh, man, wow, uh, Lloyd Austin Weeks, not months, very aggressive. He's coming out with a lot of force. He's making a stand he's leading with some gravitas. Wow. Would have been useful if some of that showed up in Afghanistan, but not much there. Uh, now here is Lloyd Austin. You may remember him, uh, kind of hard to remember what he looks like here. He has two masks on and a face shield. So this is America's bravest, finest, you know, really, really tough, strong military men. Uh, this is what he, this is what he's focused on apparently. So, uh, this memo came out from his office, August 24th, memorandum from senior Pentagon leadership defense agency, DOD field activities. Uh, he says to defend this nation, we need a healthy and ready force. You see that healthy. So he, he supports health with two masks and a face shield after careful consideration with experts, blah, blah, blah. I've determined, it's necessary. I have determined it's necessary. Not a doctor, not anybody. Uh, just a, uh, double mask or face shield or military guy. Mandatory vaccinations are familiar to all of our service members and their mission critical our administration of safe, blah, blah, blah, urgency, professionalism. I direct all secretaries of military departments to immediately begin full vaccination of all members of the armed forces under DOD authority on active duty or in the ready reserve, including the national guard who were not fully vaccinated. I therefore direct begin full vaccination service members are considered fully vaccinated two weeks after completing the second dose. Those with previous infections are not considered fully vaccinated, which is curious because there's a lot of data out there that has some interesting questions about whether the vaccine or whether the natural immunity that one gains after getting COVID, which one of those is superior don't know. But Lloyd Austin has picked his decision. He's made his decision. He said the vaccine is superior, mandatory vaccines against COVID-19 are only going to be used. We're only used COVID vaccines that receive full licensure from the FDA service members who are actively participating in trials are exempted. Mandatory. Vaccines will be implemented according to this policy. And we now know the secretary should impose ambitious timelines for the implementation. But when that happens, the harder you squeeze, right? The more stuff is going to slip through your fingers. You're going to squeeze, squeeze, squeeze. Whereas if you just kind of held it on nicely, you'd be able to move that. But when you squeeze, it just slips right through, uh, that's from its ad says, I actually like wearing a mask, keeps those randos from talking to me at the supermarket. But honestly, if Illinois mandates this, I will purposely go out in public without a mask for no other reason than for me to have the opportunity to smile at an officer and say, why don't you and your partner go play hide and go blank. Funny how, as you get older, you find different and pleasures in life than when you were younger. That's from it's ed. Uh, so I'm, I'm sort of, of the same mindset. You know, if there's opportunities to introduce friction into these, what I would consider to be unlawful, overextended, unconstitutional, totally lacking in due process, any of these regulations, these executive orders, these laws that are just mandated by your savior from Oregon, you just introduce a little friction into those things. That's okay. Never encourage breaking the law. If it's a mandate, then it's a mandate, got to follow the laws. But if you have some questions about enforceability or where, where to wear that mask, or if it's always required or any of those things, well, you have a right as an American to probe those boundaries, don't you and the officers can correct you. And if you look, if there are repercussions from you exercising your freedoms, then you deal with that on the backend. As long as you're somebody who can tolerate those consequences and those repercussions and prepare to stand and fight against them. Many of us are wants to know, says the Latino. And you know, the B words, what, that's, why I don't think the Democrats are going to get their vote to see what happens in California. These governors ruin them, the money. I thought about that to sort of, uh, an unreasonable search would be the argument that they are fixing something to the kids that is, uh, allowing them to see who they talk with and where they go and what they do and all of those different things. But then a parent might have some problems with, I think that what you might see come out of the courts is the courts will look at the situation and say, yeah, but we didn't send that home. This was only taking place in the school. We have a right to know where the kids are at school. Kids have a lower expectation of privacy, which is sort of the standard that we talk about. When we do fourth amendment analysis, do you have a reasonable expectation to privacy? If you do, and it's reasonable like you have in your home, uh, thankfully still then you are protected there, but that expectation of privacy it's, it's not as strong in your car and less strong at school because at school you're sort of giving your kids over to the custody of the government in a sick way. But, uh, so I'm not sure that the parents would have much recourse there. Uh, and it would probably be hard to sort of prove damages as well, other than a, uh, you know, nominal invasion of privacy damages, but were the kids harmed? What were they, what would they sort of when if they were successful in their suit, is it worth bringing a lawsuit? Some of those are the practical, boring things as to why people don't Sue. So Viking says Oregon's governor, once again is stunning and brave with her decisions, neutering, Portland, police protection and virtue signaling with her mask mania gross. She's just terrible. A January six, protesting

Violation. One of these cases that the us government is making a big deal about, oh, this is the crime of the century. Apparently Owen Shroyer almost took over country, but I didn't see any pictures where he had the podium. So I'm not sure how he's able to do that. But the point here is they're charging him with these crimes, which are basically disorderly conduct and criminal trespass crimes. And they're turning this into another one of the crimes of the century. So he was charged and he came out. We played the video on Friday, last week where he said, listen, I gotta turn myself in. It's a very scary thing. The U S government is already holding many January six protesters, still in custody, not giving them due process, not granting their bail or bond motions and kind of just treating them like political prisoners. I don't want to be a part of that. And so you could hear it in his voice that this was a concerning thing. He had a prior open case in 2019 from other, uh, uh, protest activities. And he's a journalist. And so he goes around and he does these types of events. So now the U S government is prosecuting him. The reason this is a little bit, uh, interesting is because he is a member of the media and you can see that sort of outright, right? He's on Alex Jones is a, uh, info wars. He's on this, this, uh, portrait here. This came from the FBI criminal affidavit. You can see that there where's Waldo champion. The people over there at the FBI, they spend a lot of time searching and putting red bubbles around people in pictures. So we call them where's Waldo champions. This guy did a very good job, was able to find Owen Shroyer right on the front cover of this thing. Wow. I mean, he's not, not even hard to find. So he found him pretty quickly. This one's a little bit tougher to find where's Waldo over here. Oh, look, it's Owen Shroyer, allegedly, according to the FBI documents. Now it's very curious about this as well is Alex Jones seems to be right up here on the, on the Bullhorn taken over the communication conversation with the crowd and these not too far off from Owen Shroyer, Izzy. So the question is Alex Jones going to be charged

For this too? I don't know, but now

We can see that this isn't a video that says specifically Alex Jones tried to stop the storming of the Capitol. So the FBI is playing there. Where's Waldo game on a video that said that they tried to stop the storming of the Capitol. And so they're circling with their where's Waldo finder, uh, Owen Shroyer now where this could be a little bit more problematic is this photograph where it looks like he's actually kind of on the steps of the Capitol, which is a little bit closer, a little different than this. We don't know where this is, but this one looks like he's closer up in there. And it looks like it's the same outfit, you know, same purple, uh, same black, uh, uh, external vests. See that same going on here and here. And so FBI agent circled this

One. Wow. You know, probably took him a little bit, uh, you know, a couple of days to find that one, but

Is there's Waldo. Now we've got a complaint. This was filed on August 19th. Talked about that last week, went through that in its entirety. If you miss that video, go check that out. We went through the entire complaint for orange Shroyer. We also have on 8 24. Now a couple things happen. I don't want to spend a ton of time on this because

It is a little bit of, um, some, some in the weeds, legal stuff,

But a couple of things happen. So the judge came out and actually said,

Listen, we have a lot

Have competing interests here that we need to talk about. Course we have the government's interests, the prosecutors, the us government, the us attorney's office, the DOJ. They want to make sure that people don't

Speaker 2:

Storm the Capitol. So they've got an interest

Speaker 1:

In prosecuting the people who violated the law. There was a public harm that happened here. Uh, many people say it was the worst thing that ever happened in American history. I disagree. It seemed like a

Speaker 2:

[inaudible] semi violent in certain areas, protest that got problematic, that really resulted in huh?

Speaker 1:

Hundreds of criminal trespass and disorderly conduct charges. That's it. They happen to be in the Capitol, but these are not crimes

Speaker 2:

Aims of the century been saying that for months now, eight months, I've been saying that the

Speaker 1:

I, for some reason, it's still charging them. They found where's Waldo here. They found Owen Shroyer. They charged him. But now we know what the U S government interest is. They want to protect the capital. Fine. We also know that we've got a defendant that we have to think about. All the people charged. They have due process. They have the presumption of innocence. They have the right to be released, absent

Speaker 2:

Any, you know, sort of, uh, extenuating

Speaker 1:

Circumstances that would justify their continued detainer. And the list goes on and on all of your constitutional rights, your right to counsel your right to present evidence, your right to cross examine witnesses, all of it. Gotta make sure we protect those things as well.

Don't we? Yes. In my opinion, the DC courts have not really

Speaker 1:

Agreed, but that's okay and not okay. But that's reality. We also have a third competing interests. The journalist, the people who were covering the stories, and this is a new actor in this entire dynamic. What about journalists who were there just covering

These cases? What about

Speaker 1:

The guy who sold his video footage for 35,000?

Speaker 2:

What about this journalist? So the judge

Speaker 1:

DC circuit court is asking the prosecutors to clarify. They want to know what is your media policy in the Capitol riot case? Why are these new limits on pursuing journalists not applicable? In this case, you remember that attorney general Merrick Garland last month issued a memo. He wanted to list li limit the justice department, uh, probes of journalists. Remember this? He said, now this is an early test. This is there's a judge overseeing a criminal case here against Owen Shroyer, a talk show host on info wars and an order made public judge.[inaudible] said, prosecutors refuse to answer on the record, whether they complied with the department's policy. We know that Merrick Garland came out and said, yes, the department of justice is going to change. Some things is to how we, as to how we probe journalists. Remember this, this is all the hubbub over Donald Trump apparently was investigating or, or, uh, subpoenaing records

Speaker 2:

From journalists. And so attorney

Speaker 1:

General Merrick Garland came in and said, we're better than that. We're not going to do what that orange maniac did. And so we're going to change our journalist policies. We're not going to go and probe into them.

Speaker 2:

Um, then they charged Owen Shroyer. And so we're going

Speaker 1:

See what they say and how they justify that last month, Mr. Garland limited federal prosecutor's ability to obtain records of reporters contacts when investigating leaks of sensitive information, a free and independent press is vital to the functioning of our democracy. The attorney general feigned in a memo to federal prosecutors, Mr. Garland said the agency's prior policies hadn't properly weighed the national interest in protecting journalists from forced disclosure from their sources. Right? So what we're talking about here is sort of what can the government extract out of a defendant who is a journalist, do some of the media protections, the, uh, the, the news protections apply to these journalists and how do you balance those things out? You've got January 6th, the worst insurrection ever. And you've got this really, really, you know, chaotic scene where prosecutors are throwing everything that they can at these defendants, but they're simultaneously wanting to protect journalists. And so far, so much to the extent that they even issued a memo and changed the policies dramatically in order to make that. So how do you balance these two out? How do you reconcile the two opposing competing interests. Let's take a look. This is what the judge had to say. The judge yesterday came out with an addendum order and he's asking the court or asking the prosecutors are telling, ordering them. You've got to do something. This is USA vs. Jonathan Owen Shroyer. It's nine pages. We're not going to go through it in entirety, but I want to show you what's happening here. August 19th, the court issued an arrest warrant. So pay close attention. Remember how this works. We've got the FBI agent files, an affidavit fills out a complaint. We've read many of the complaints here on the show and they all say January 6th, support and date, you know, Mike Pence, counting the votes, all the Congress, people in the building, right? Blah, blah, blah. Very scary. They all got evacuated. Alex AOC got PTSD, blah blah. Right? So on August 19th, then FBI agent fills all that out. Sends that into the court, says, judge, look this Owen Shroyer guy, bad dude. He was on a stage and he was next to Alex Jones. And then he was on the steps of the Capitol building. We got to go get him. So the FBI agent where's Waldo champion of the day said that, uh, we're going to draft this complaint and go serve that in into the court. And the court then is going to grant a warrant so that we can go arrest this guy that happened back on August 19th, they issued the arrest warrant. The department of justice recently updated its policies about investigating media members. Part of its review. The court, the judge here asked the DOJ. If they comply with this rule, it's called 28 CFR 50 10 a policy regarding information from the news media specific law that says, listen, if you're going to be sort of, you know, playing around with, newspeople make sure you're complying with this rule. The judge asked the prosecutors to follow the rule. The department refused to provide an answer on the record. The prosecutor's not answering anything. The court then issues this addendum opinion to ensure the record accurately reflects the following conversations between the core and the DOJ and the departments break with its prior practice of confirming its adherence to these regulations. Huh? So, so what the judge has said there is, uh, Hm. Okay. We had a hearing on August 19th. And when you came in here, I asked you specifically, I issued this warrant. What is your policy about going after members of the

Speaker 2:

Media and the us attorney's office? According to the judge, refused to provide an answer on the record. We don't know, uh, well can't answer you or not answering or a bunch of equivocating statements. We don't know. So the judge then said, just to

Speaker 1:

Be clear, just so the record is clear. I'm going to tell you what I want for you.

Speaker 2:

You don't want to put it into writing and you're going to have to go do it. You have historically confirmed to this court. The judges implying that you have been following the mandates under the code of federal regulations that you've been complying with that regulation when you're investigating members of the media. Now

Speaker 1:

Twenty-five times in the past, but now today you're not doing that. Why? Very curious. And so now we're going to clear the record up aren't we? So this judge says in response to a draft copy of this adenoma,

Speaker 2:

The justice department submitted a, an attached to letter. We're going to take a look at next. Judge says, quote, it misses the mark. True.

Speaker 1:

The department of justice retains the right to do what it wants with these regulations. But this renders the DOJs newfound silence no less concerning.

Speaker 2:

The department of

Speaker 1:

Justice has volunteered such information in the past without any demonstrable huh.

Speaker 2:

Harm to its deliberative process. The central question was not how they compiled the regulation, but if they did okay. So the judges sort of in this paragraph, rebutting what the prosecutor says. So the pro, so the judge on August 19th says, Hey,

Speaker 1:

Prosecutors, are you complying with the media rule? Yes or no, they don't answer.

Speaker 2:

So the judge then says, well, uh, you better answer that for us. And, uh, they sent a letter back over to the judge. This was drafted on August 23rd. So the prosecutor

Speaker 1:

Now sends this over to the judge

Speaker 2:

And they say, judge, we're responding to your request that you didn't get a good answer about how we're complying with the rule.

Speaker 1:

We regret that the court has found our response unsatisfied

Speaker 2:

Actory we believe it's appropriate as the,

Speaker 1:

They say, as noted in the order. The question before the court is whether Shroyer committed federal offenses. When we reviewed and submitted the complaint in the arrest warrant, the court asked about certain media safety,

Speaker 2:

But they say those safeguards fall within the province of the[inaudible]

Speaker 1:

Negative branch. And they do not bear on the question of probable cause before the court. So the prosecutor sent a letter back

Speaker 2:

Back over to the judge and said, judge, thanks for asking about that media policy. It's none of your business, it's our business, right?

Speaker 1:

If we decide that we want to prosecute somebody and we, we think there's enough probable cause. And that's the only thing we're asking you to do

Speaker 2:

Inquire about. Thanks for asking about it, but kind of none of your business, isn't

Speaker 1:

Clear the recent attorney general memorandum and the applicable regulations relating to the news media. They are binding amongst a department attorney

Speaker 2:

In the us attorney's office, like all other components. These are scrupulously followed. Likewise. We have training accountability, attorneys who follow the rules

Speaker 1:

Are sanctioned. Got it. The representations that the department provided previously to the court were intended to underscore these

Speaker 2:

Points while recognizing that we follow these rules in principle,

Speaker 1:

July 19th, Merrick Garland issued a new memorandum, said that there's a use of a compulsory process with members of the media. However, they say the policy does not give rise to an enforceable, right? So there's telling us, even though the DOJ,

Speaker 2:

The policy, so what our policy, we don't have to do it if we don't want to. If we decide that we're just going to not comply with that policy,

Speaker 1:

That's our business judge. The only thing we're asking you to inquire about is the warrant and probable cause. And if there is enough of that to issue the warrant so we

Speaker 2:

Can go arrest him,

Speaker 1:

Typically not a good strategy to tell a judge that it's none of the judge's business, but see how this worked out for him accordingly, a requirement to proffer to the court, how, and on what basis the executive branch has made determinations is inconsistent with the appropriate role of the court.

Speaker 2:

So

Speaker 1:

Don't ask us about it because we might have to disclose privileged deliberations. Moreover, such inquiries could be risk impeding the Frank and thoughtful deliberation. So the prosecutor is saying, judge, if you ask us about that, if you inquire about whether we complied with the rules, we're going to have to tell you what we did. And if we tell you what we did well, that might breach internal privilege deliberation. So they don't want to do that. They say, we appreciate the issues animating the court's inquiry, but we do not believe it's appropriate for the court to inquire as to how the government implements its internal policies. Particularly when dealing with actions of the executive branch, this is a separation of powers issue. They give us some case law here, separation of powers, forbids the courts from becoming continuing monitors of the wisdom of the prosecutors. And so on. They say as the court notes, our office conferred on previous occasions, certain aspects of the media policies, but those are distinguishable from this case. And so we're not bound by those here signed off on by John crab, junior chief of the criminal division of the us attorney's office.

Speaker 2:

Um, so the, the, uh, John crab is basically saying, yeah, thanks for asking about that judge, but we don't think

Speaker 1:

It gets appropriate for us to tell you that at all. And so the judge, as we noted said, it misses the Mark Justice department retains the right to do what it wants, but doesn't answer the question. Why this time, last time you volunteered all of your information saying that you were complying with the rule this time. You're not saying that. Why is that? So the judge said, this is the inquiry on August 19th. This is back to what the judge wrote. So we just went through the prosecutor's letter. The judge is now saying, this is not, this is why this is problematic. On August 19th, we had a telephone conference, the undersigned, the judge inquired. They want to know as to whether the DOJ

Speaker 2:

Considered Shroyer to be a member of the media. So we want to know, right. They said their letter back was we don't think

Speaker 1:

Appropriate for you to inquire about our internal policies. The judge says I don't care. Okay, that's fine. But I also want to know, this is sure you're a member of the media. I need to know that the USAO had complied with the DOJ policies regarding the arrest of media members, whether they had complied with other media members and whether the assistant us attorney would memorialize the answers to these two questions in the complaint, consistent with their prior practice. Okay. That was back on August 19th, us attorney's office said it, it had followed internal guidelines, but was not willing unwilling to memorialize that or explain the basis for its determinations.

Speaker 2:

So the judge

From the pers case, U S attorney's office, they got an arrest warrant for another Capitol hill. Defendant was wearing a black vest, had the word press on. Either side, had a long black pole statement of facts included a footnote saying the defiant could not identify that he was associated with the press or had any press credential

He didn't apply. The court rejected that warrant because there was little to indicate what the U S attorney

These were saying. They resubmitted it saying that

He was not a member of the press. And then the judge issued the arrest warrant. So what's happening here in a different case. In the purse case, the us attorney's office went in, filed a criminal complaint with a request for a warrant to the judge. It went over to the judge. The judge said, okay, I'm looking at this. I'm trying to determine if there's enough probable cause here to sign off on your warrant. So you can go arrest this man. I have a couple of questions about the case. You've done an investigation here, and I'm looking at your basis for why I should write this warrant. And I'm looking at the picture and it says he has the words press on his shirt in a black vest. Is he a member of the press? Because if so, that might adjust the probable cause determination as to whether a crime was being committed or whether it was a journalist doing journalism

Things. They have some leeway for a whole

Slew of different reasons. So the judge is trying to inquire. They submit the request for the warrant. The judge looks at, it says, I don't see anywhere in here, whether this is a member of the press or not. And there are some facts that tend to make me believe that he is so the justice department in that case said, okay, judge, let, let's clarify this for you. He's not a member of the press. We went and found it. And they wrote it into the criminal complaint and they submitted it. And the judge said, perfect. So I'm taking a look at this. All right. That all sounds like it's a crime. He's not a member of the press. So there's no exemptions there. Perfect issued the arrest warrant. Sounds like a pretty reasonable approach to it. So

This time now they're not doing it. Judges asking why? Because this guy,

I certainly seems to be like, he's a member of the press. He's on info wars website, right? He's does journalism

Being all the time. And they're not willing

To memorialize that. Why not? The judge was asking about that. He said another recently unsealed application also reveals their prior willingness to assure the court followed the guidelines. A different case, finds a different case here

With the requirements of the U S code of the CA a code of federal regulations found a different one, right? So the judge is going back through and said, well, you did it. In that case,

You did it in this case, you did it in that case. So why not? In this case right now in front of you,

But here, the judge says the government is unwilling to address its compliance with its internal regulations.

Even if a credentialed journalist engaged in the instant conduct, there would be no question of probable cause for the arrest. So he's going to be

They still have thousands, tens of thousands of hours of video that they're organizing. They've been doing it for eight months. They just hired a new company in June and they just started transferring the materials. So the judges go, oh really? You need more time. Oh God, it sounds like it's a lot of evidence got a lot of Waldo books you got to go through. So most of the discovery to my knowledge is still not disclosed. So how can you find out you, you can't find out where all the tentacles crisscross, so you can identify people who might be co-conspirators or undercover agents, or, you know, paid informants or whatever, until you start going through the discovery that the government is refusing to disclose. Isn't that fun. We have another one here from thunder. Seven says this is an absolute madness. The dams are desperate at the Arizona audit distracting with nonsense like this didn't even enter the building, just an observer. And I heard Alex Jones talk about how he stopped hundreds entering the building. As he knew it was a trap. He asked the police to stop them entering and told them he could do it, which he did with a bull horn and probably stopped more innocent maggot people being thrown in prison, right? In the FBI affidavit, they have a video of a screenshot from videos that were posted, saying, Alex Jones is trying to stop people from

So you can just take it. It will take you over to court. listener.com and court listener.com will give you access to a lot of the, um, court documents. In federal cases, federal cases are behind a paywall, really it's called pacer. And, uh, you have to be an attorney to log in there and you get access to the cases. But many attorneys like me when I go and I browse those, there's a plugin that when we view files from the federal website, it will download the files and automatically upload them creating sort of a mirror repository of a lot of federal court documents. Those are over on court listener.com. And so, uh, any, anytime, any documents that I see just automatically get uploaded over there, we're all sort of doing our part to spread the information around. So you can find a lot of that stuff at court, listener.com or download the slides. And I, I try my best to put links in to the original sources on the slides, for questions like that, so that people can download them and start going through them on their own. We have Perry masonary says if the Watchman watch themselves and there is no accountability, of course not. That's right. That's why we always say that, you know, all of these bureaucrats who investigate themselves and have commissions and they go to internal affairs and they, uh, you know, really do a deep dive on their own misconduct and weird. They didn't find anything. Again, strange happens all the time. I don't know how a news now I owning says, okay, more serious question. Now for crimes like this, when does the speedy trial concerns start coming about? I understand they need a lot of time for murder charges, but this is a lot less than that. Not if you talk to the U S attorneys, I think that murder charges would be like a lower level offense. In fact, maybe these people could plead down to murder. Well, we're not going to charge you with a criminal trespass or disorderly conduct. We're going to let you go. Cause we want the death penalty for that. We'll let you plead guilty to murder

Years in prison. Give you a light sentence because what they did was almost ruined the country. Apparently now for the speedy trial stuff, we talked

There's a lot of complexities with the speedy trial stuff you've got, you've got the ability to waive time. And so if the defense is waiving that time, then any time that elapses that the defense waves doesn't count against the clock. So if a defense attorney waives that time, or they just agree to a continuance that excludes that time from the calculation, then they're there. You know, the speedy trial stuff can go on indefinitely. And we've seen that with a lot of January six cases. And even in situations where the defense objects to continuances to saying no, no, no. We want our trial immediately. The government has not given us the disclosure that we need. One of the tactics that defense attorneys will often use is if you get charged with a crime, you'll use your speedy trial rights in order to force the government's hand. If the government charges somebody with a crime and they're not really ready to proceed yet, you could use that to your advantage. That is often a reality. The government charges people, but they don't get the blood results back in time or something, right. They have a witness that they're not able to secure and bring into a trial. So what you do is you use the speedy trial, right? And you say, I'm not giving up a day. I'm not waiting one day. I'm going to make sure that we are enforcing our right to a speedy trial. And I want my trial like next week, the judge will say, well, they're not ready next week. And so they're gonna, you know, they'll give the state as much time as they can within the speedy trial rules to bring the case. And if their speedy trial is coming up, if that deadline is coming up and the government's not ready, guess what they got to dismiss the case. So there's an acronym. It's called war. We're always ready. We're ready, better. We're ready faster than the government is. We do more work faster. We're prepared, ready to go. And if they're not, you can use that to your advantage. But there are also situations where you can be a defense lawyer and you can say, no, judge we're ready to go. They don't have their evidence. They haven't given us 14,000 hours of video footage from the Capitol building too bad. That's their problem. We're ready. Now, the judge can say, well, these are extraordinary circumstances. These, uh, you know, these situations situation is problematic. And so what I'm going to do is I'm going to grant the government to continuance anyways, and I'm not going to count that time against them. I'm going to count that against you defendant. And so your speedy trial rights sort of gets dumped all over because the government needs more time. And the, the judge finds that that is a reasonable request and they exclude the time out of your calculation. So this can, this can go a number of different ways, right? And it also depends on if there's a plea offer. It also depends on the strength and the weaknesses of the case depends on the defendant, depends on whether he wants to contest this thing or plead out to a low-level misdemeanor offense. You know, there's a lot of, of complexities that go on in any of these cases, which is why it's a good idea to hire a lawyer. We offer free case evaluations are our law, easy.com. My biggest issue with this case is the idea that the government can decide. You're not a legitimate member of the press. Freedom of the press says nothing about credentials, tagging yourself as press seems pretty basic and should suffice some John Haugen. I liked that John. Yeah. Right? Who gets, who press credentials. Right? All, all of that I think is, is, um, connected back constitutionally to time, place and manner restrictions and things like that. But I understand what you're saying. We have this sort of pseudo sophisticated class of the media journalists. And you know, they don't like independent media. People like me, people like you, people who are, you know, offering commentary and doing our own digging a little bit and talking about stories because they want you to go to CNN. They want you to go to Fox, to MSNBC where they tell you what the news is. Remember who, who was it saying that, um, well they're all on this misinformation kick. There, there was some news anchor who was very mad that said, don't look into that. We tell you what the truth is. I think it was Cuomo actually. Now that I think about it, uh, Laci says, please, Rob, I beg you never, ever put on Kamala's cackle. We have an extremely sensitive hearing. Dogs are not the same after listening to that horrible, evil sound. That's from Lassie. Unless, you know, uh, you know, I've got, I've got a strong vote in favor of the Camila cackle. And I've got Lassie over here who says don't do it. So it's a difficult position to be in. If we do the Camila cackle, it's only going to be used very, very sparingly that's for sure.
