Hello, my friends. And welcome back to yet. Another episode of watching the Watchers live. My name is Robert ruler . I am a criminal defense attorney here at the RNR law group in the always beautiful and sunny Scottsdale Arizona, where my team and I over the course of many years have represented thousands of good people facing criminal charges. And throughout our time in practice, we have seen a lot of problems with our justice system. I'm talking about misconduct involving the police. We have prosecutors behaving poorly. We've got judges, not particularly interested in a little thing called justice. And it all starts with the politicians, the people at the top, the ones who write the rules and pass the laws that they expect you and me to follow, but sometimes have a little bit of difficulty doing so themselves. That's why we started this show called watching the Watchers so that together with your help, we can shine that big, beautiful spotlight of accountability and transparency down upon our system with the hope of finding justice. And we're grateful that you are here in with us today. We've got a lot to get to a lot of Afghanistan news going on. President Biden spoke this afternoon, but we're going to take a look at what the rest of his administration had to say today because we had CIA director, William Burns met over with the Taliban. We've got Jen Sacchi three or four different clips from her today. She was out there. She gave a press briefing and it was an interesting one. She had some interesting language that she was using with the press Corps . And so we're going to check in there . Representative Adam Schiff, Democrat from California, came out and also came out of an intelligence briefing and said, well, we may not get everybody out of there by August 31st. So we're going to check in with him and see what he has to say. But a lot of Afghanistan news we'll spend some time there. Then we're going to change gears in the second segment. We're going to talk about what's going on in California in particular Los Angeles, because they just came out with one of the biggest cities in the entire country. And they are now mandating vaccines , uh , close, almost very, very close. This is on mayor Garcetti's desk. And so they're going to mandate vaccines for all city employees. LA one of the biggest cities in the country said this in season one of COVID. It starts in New York and then it sort of goes to the other coast and then it percolates out everywhere else around the country after that. And so LA is about to fall as well. Firefighter named Christian GRA Nucci 31 year veteran unhappy about this. He's been a firefighter for 31 years, and now that LA is going to be mandating vaccines. He's got some things to say about it. So we're going to hear from him. And then in our last segment, very surprisingly, Michael, Abinadi got a mistrial. I thought that we were going to never talk about that guy again. And here he is. He has a , uh , a chance to live another day, meaning that he has an opportunity to be re prosecuted and go through the whole thing again, if the us attorney's office decides they want to do that going to guess they do. So we're going to take a look at that surprise. Mistrial happened today. We're going to go through his motion and see what the had to say about that quick reminder. So, all right, enough of that, let's get into the news of the day. Afghanistan looks like we're actually leaving this breakup is official. No going back. No set . I'm sorry. I was just thinking about you a good morning. Just thinking about you. None of that Afghanistan, it looks like it's going to be over Joe Biden is holding true, staying fast to the August 31 withdrawal deadline in part, because that's the deadline. He set also in part, because that's the deadline that Taliban set. They said , uh , that's our red line. We talked about that on the show yesterday saying specifically that , uh, they don't, they don't want one, one additional troops there after August 31st calling it an occupation saying that we don't need this at all. And so the Taliban is now really encouraging the U S to get out of the country quickly on August 31st. And the U S because of their incompetence has suddenly botched this to such a degree that they really have no leverage. They have no cards. There's nothing to even negotiate because the Taliban presumably has a thousands of American hostages that are , uh , in their grasp. And so we've got to dig into this story right now. There's a lot of questions still surrounding this August 31st deadline. We've got just a handful of days, less than a week until that deadline comes up. And so many people in the media, many elected officials, many American citizens like you or me, many non-American citizens, many , uh , citizens from all over the world are asking what happens on September one. What happens when August 31st comes and goes? And , uh, they're still Americans who were trapped or stranded to use Jen sockies word over there in Afghanistan. What do we do about that? So the byte administration, you know , very, very forthright , uh , planning for every single contingency they sent over CIA director, William Burns. He went and had a secret meeting in Kabul with Taliban leader. Abdul-Ghani this was posted six hours ago from the Washington post as CIA director. How the secret meeting on Monday in cobble with the defacto leader, this was the highest level face-to-face encounter between the two sides since they took over the capital U us officials with the matter spoke on condition of anonymity to discuss this diplomacy, Britain, France, other us allies. They're telling everybody that more time is needed to evacuate their personnel. Taliban said, well, if it's , if you cross August 31st, that's going to be a red line for us. And it's going to trigger unspecified quote consequences. Now you juxtapose that with some of what we talked about yesterday, we heard from Jake Sullivan, NSA came out and said, well, we have a real persistent, ongoing threat from ISIS. And the U S embassy specifically said, don't come to the airport unless you get clear notification from the U S government, that it is safe and appropriate to do. So sort of begging the question or speculating that people are corralling around the airport. Like we've seen in the video footage, creating these huge crowds. And that makes it a very prime target. If you're going to have a bunch of people huddled into a , a very tight space, you set off an IED, and then you have mass destruction. So the U S government is encouraging American citizens be extra careful. Don't go, don't call us, we'll call you. And then you can come to the airport. So , uh , CIA over there, negotiating with the Taliban, see if they can work out an extension, not looking like that's going to happen. Mitch McConnell earlier was saying, well, just ignore it. Mitch McConnell, of course, is the Republican Senate leader. He came out on Tuesday and said, well , uh, this is a lot worse than Saigon. He says, the president needs to just forget about the August 31st deadline, extend the deadline, go outside the perimeter, make sure every single American who wants to leave is able to get out with our assistance. And our Afghan allies said that on Fox Taliban should not be allowed. He says to tell us how long we are there to get our personnel out. That's our decision not there says McConnell, which is a very nice concept when you're in a position of strength, when you have power and you have more cards in your hand that you get to play those cards and you get to sort of set the terms, but that's not what happened here. The United States government through the byte administration, through the military intelligence community, whatever, they all created a situation where the us has no leverage. The U S has basically said, this is our position. You have all of our equipment and citizens and allies, and you're going to have that for the foreseeable future. So this is now something that the U S government sort of has to fix, right? They're kind of responsible for it. I just saw a Superchat come on in here from our good friend, Viva fry over there. And so Veeva is doing very good work and he's running for office. And so we're going to have to connect and make sure that we promote that campaign because we need more good people running for office. Thank you for that Veeva . And so Veeva obviously is , uh , you know, following the Afghanistan news as well, Mitch McConnell says, got to stay there, but what leverage do you have? Because if you, we have no military base over there not going to have an airport soon, don't have much equipment don't, don't tell them , have access to , uh , other American citizens over there. So that's all a little bit problematic. Isn't it? So Mitch McConnell, it's a nice thought. It's a nice idea, but that's an old America. That's not the current America anymore. You're, you're remembering back 20 years ago and that doesn't exist now. So Biden came out and said, well, we're going to pull out. I know that the lawmakers are complaining, but we're still leaving said, he's going to stick with his deadline next week for completing the U S led evacuation from Afghanistan administration officials said on Tuesday, the decision reflects a growing fear of extremist attacks at the Kabul airport. Talked about that ISIS might be targeting the crowds that Cora or corralling over there . Taliban spokesman speaking, prior to the word of Biden's decision set, a new that the militant group would oppose any extension of the August 31 deadline. It has allowed airlift to continue without major interference. Yeah, that's nice. They have allowed that, right. There's I think one strip on that cobble airport. And so if the Taliban wants to take that out, it's not really complicated to do that. They have control of the whole vicinity. The U S government is basically emasculated at this point. So , uh , we'll see what happens. Now. A lot of clips here from Jen Sakhi over at the white house, Jen Saki is here today. She is very, very confusing because yesterday she was telling us that the word stranded was very offensive. And then today we're going to hear that. Well, maybe some Americans are going to be stranded. I'm sorry about that. So we're sort of getting a lot of chaotic responses from the white house, probably in part, part of, you know , almost strategic to some degree, you just go out there, you do these media blitzes, you present multiple different angles of the same thing. And everybody goes, well, you said this, the DOD said that the NSA said that the secretary of state , uh , Joe Biden came out and said something that is disconnected from all of them. So , uh, what, what is going on, and a lot of people are scratching their heads as are you and I, so , uh , here is Jen Saki . Now the conversation, of course, as we're encroaching , uh , approaching the August 31st deadline as well. You know, you think about this of strategically, you've got these, these crowds, these scenes that look like they're from a zombie movie, sort of swarming over the airport. And now we've got a situation where that needs to be maintained while the last American aircraft and citizens are airlifted out of there. So are they going to be evacuating on an airplane with more Afghanis falling off of the landing gear again? I mean, how , how do you secure the airport from the encroaching literal hoards of people trying to flee Taliban to tyranny? There's no Afghanistan army to secure the airport. There's no real air , you know , American presence there because we got to pick up all the American men and women as well. So I guess I'm not a military expert, but it sounds like it might be a little bit problematic. So a lot of people are having this conversation saying, wait, so, so Jen Saki from the white house, it sounds like what you're saying is we're going to be cooperating with the Taliban, the same people we've been fighting for 20 years , uh , over there. Now we're going to just be like, Hey, can you guys just make sure that you keep the Afghanis away from us while we evacuate while we just put up the landing here and get out of here. And she's kind of saying, yeah, that's exactly what we're talking about. That's the white house strategy here she is.
Speaker 2And that completion of the mission by August 31st depends on continued coordination with the Taliban, including continued access for evacuees to the airport. So
Speaker 1It's like, you know, so they, they, they need the Taliban to continue to cooperate with the U S I mean, basically this is really going, according to however, the Taliban tells us it's going because they control the airspace and they're going to control it indefinitely. The white house is now acknowledging that yeah, we're going to have to cooperate with them. It's not going anywhere. So , uh , we'll see where that goes. Now here's another clip from Saki. Now, again, the media is really trying to dig in on her and try to find out what the deadline is and what do we do about this deadline? And they've been very coy about this for a long time. We talked about this a lot yesterday, trying to gauge what the total number of Americans left in the country are a lot of people in the media trying to figure that out as well, but nobody will give any answers about that, which is problematic because if you knew the total number, let's say that there were 10,000 people left. You got six days left to get them out. Okay. You can do some simple math on that and come up with an equation and then pace it out and then make sure that you get everybody. But they've been very reticent to do that. They don't want you to know what that total number is because then you have a scoreboard. If you come out at the end of this evacuation, you can say, well , we're counting all the airplanes, the landed here in the United States, we're doing a debrief. We can tell you how many us citizens that came across, but that doesn't match the total number. That's still over there. And so they've been very coy about this. Jake Sullivan, Oxford graduate came out and said, well, it's not our fault. Americans come. And they don't register in Americans leave. And they don't tell us they left. And also they could have left Afghanistan a long time ago and they didn't. So it's kind of their fault anyways, isn't it? And that's the byte administration. So here is Jen Saki . Now somebody is asking her specifically about this. If you have to adjust the timeline, how long are we talking and what are we going to do about it? Here's Jen,
Speaker 3I could adjust the timeline. How long are you talking about ,
Speaker 2Uh, I'm not going to get ahead of any contingency plans that are drawn up by the state department and the defense department, as you all know , uh, the president has been meeting , uh, and being an attended and participated in , in briefings with his national security team. Once a day, sometimes twice a day is in constant and regular contact. And I expect we'll get some updates in short order. Okay . When do you need to start
Speaker 3Pulling troops out of the airport to meet , to meet the October 31 ?
Speaker 2It's a great question, Steve. I just don't want to get into operational details that are under the purview of the department of defense. We're just
Speaker 1Correct. It's a total punt, right? Jen , we're leaving in like seven days. It's a , it's sort of everybody's purview. Now. Don't just think, good Lord. It's not like you have several months to plan this. Oh, sorry, media. We don't want to tell you about our detailed military planning. You gotta be out of there in seven days, Jen . So you might want to give some information about how you intend to do that because there's a , a lot of people here who have some problems with how this is all going now, Jen Psaki yesterday also was very upset with Fox news is Doocy who is in the press briefing room and said , uh , something like this at Jen , you know, kind of seems problematic to many Americans that you're just going to pick up and leave on this August 31st deadline, stranding Americans over there, and our Afghan allies, the people who were part of the war effort for the last 20 years who have built their entire lives in Afghanistan, who grew up, we have 15, 16 year old kids who only know a secure Afghanistan under the purview of the United States. And so all of those people, all of those lives that have been built over this last generation, they're all going to be stranded. And Jenn says, no, no, they're not stranded. Now I wanted to pay close attention. This is a clip from yesterday, but just put these two side-by-side , we're going to play this one first. And then Jen comes out here today and it sort of like, yeah, well, we are actually going to strand people. So here is Jen in very, a moral, morally indignant about what's going on here yesterday about that word criticism
Speaker 3Is not of leaving Afghanistan. It's the way that he has ordered it to happen by pulling the troops before getting these Americans who are now stranded. Does he have a sense of that?
Speaker 2First of all, I think it's irresponsible to say Americans are stranded. They are not. We are committed to bringing Americans who want to come home home. We are in touch with them via phone, via text, via email, via any way that we can possibly reach Americans to get them home. If they want to return home.
Speaker 3I mean, our constraint, it is the white house is official position on what's happening in Afghanistan, right? I'm just calling you out. First thing that we are
Speaker 2Stranding Americans in Afghanistan. When I sit, when we have been very clear that we are not leaving Americans who want to return home, we are going to bring them home. And I think that's important for the American public to hear and understand,
Speaker 1Right ? So that's Jen getting a little bit feisty over here and I'm looking at the YouTube chat. Zulu is very excited about that says, oh my God, the things I would do with Jen , love it, Zillow . Like what? Ask her questions about complex foreign policy issues and see how she responds. I like that. That's fun, you know? Uh , but that's a good comment. That's true. All right . So let's take a look. Now that was yesterday. Jen comes out, excuse me. Do you see , I'm very angry at you. Don't you use that stranded word with me young man, it is offensive. We are doing everything we can to get Americans out of the country, including hello, texting, emailing phone calls. They're just not responding to us. I don't know why, because maybe they're in a war zone in Afghanistan, in a third world country with , uh, you know , uh , no reef sources , infrastructure, crumbling nation. Maybe they're not able to get your messages there, Jen. And so I guess you can just keep on calling. You only have six, seven more days to do it. And so that'll all be taken care of. All right. So that's Jen Saki , uh, who is not stranding anybody. Did you hear that? Not stranding anybody and , uh , she's offended. She's very upset about it. And so , uh , let's see what she has to say about this today when America leaves, I guess this is this a lot changed since yesterday.
Speaker 3Um , say after withdrawal is done, you know , it's the pet stuff everyone's out. If one us citizen was suddenly discovered, you know, saying, Hey , I really want to get out. And I'm stuck. Who knows where somewhere in Afghanistan or in Comstock , he's got any problems with this trigger, a diplomatic military, all hands on deck type thing to get to that person out, whatever the date
Speaker 2Commitment continues to be to us citizens. If they want to leave, we will help get them out. Again. We expect there could be some , uh, but I, I don't, I'm not going to get into it further.
Speaker 1There could be some people stranded is what she said. He says, okay, so listen, if there's one person, one person that is there and they want to come home, you , you keep saying this line. If an American wants to come home, they're going to come home. It's like what Obama said, if you like your doctor, you can keep your doctor that wasn't so accurate. Was it that it was a nice little pithy little phrase. If you had some good cadence, if you like your doctor, you can keep your doctor kind of a good alliteration. If you're an American, if you want to come home, you're going to come home. It's the same thing. And we know that the first time that they tried to cram that down, our throats from a very similar administration, didn't work out so well. And the same thing is happening here with Jen . If you want to come home, you can come home. But what about on September 1st, second, third, October, November, December. How about in 2022? Uh , what about that? And she says, well, I guess there's some people who are, yeah. Who , who , who , who just may not, may not come over here, which is the same definition as the word stranded was offered by D Doocy yesterday. And she wasn't happy with that. So very interesting little flip yesterday. We're not stranding anybody today. Yeah. We actually expect that some people could in fact be stranded. So a mixed messages from the white house. Now, if you had any doubt that they're going to get this taken care of by August 31st , um , well, let me confirm your doubts. They're not going to get it done by August 31st. Here is a little Adam Schiff over here from Congress. Now he came out, walking down these Capitol steps. I think that might be Kinzinger crying. Kinzinger back there with that woman adjusting his tie, doing his like little, what is that pose? Is that the captain Jack Morgan pose , you know, the pose and he's congresspeople are the weirdest. So Adam Schiff walks out. They have this intelligence briefing and he walks down and he says, I'm available to talk to you now, media. And apparently they were there and they were getting briefed from all of the intelligence that apparently we have somewhere in the U S government still. I don't know what it, what it is, but they had a briefing with some intelligent people, I guess. And he came out and he said, we just got an update about what's going on in Afghanistan. And I want to share some things with you. And I'm now available for questions. Some reporter asks him, Hey , so, Hey , do you think we're going to be able to get everybody out of there? You know, Americans out of there by August 31st here is what Schiff had to say. Do you think
Speaker 4That it's possible for the evacuation finish up before August 31st? I think it's possible, but I think it's a very unlikely, yeah , there , um , given the number of Americans who still need to be evacuated, the number of SIVs, the number of others , uh, who are , uh, members of the Afghan press , uh , civil society leaders, women leaders , um, it's hard for me to imagine all of that can be accomplished between now and the
Speaker 1End of the month. All right . So , uh, it's, it's unlikely, right? And so the admit , this is the , actually the first, the first , uh, I think Congress person that I heard from today that got a direct briefing from the intelligence people. So remember, there's a couple of different things going on here. You do have the intelligence community, which are trying to save face. They're all saying no, we told Joe, I mean, we had , uh , cables and memos and we were confirming that the Afghan government was crumbling and that they were not going to be sufficient to secure the country and Joe Biden and his team are sending out all of their people to sort of rebut that to say, no. Well, we we're , we're leaving. Uh, and you'll notice that the fingers are starting to point all , uh , multiple different directions. And the white house is saying , well, look, the general consensus was. And so we talk a lot about this in our law firm is a to B communication, a says something to B and B needs to confirm that back to a , in order to really clear up lines of communication. So it'd be like ordering, you know , uh , something for lunch. I'd like a Turkey sandwich with lettuce. And so you give that order to somebody and they, and they say, let me confirm that for you, you'd like a Turkey sandwich with lettuce and cucumbers. And that's not what I said. I said, I want a Turkey sandwich with lettuce. Oh, you want a Turkey sandwich with lettuce? Yes. A to B communication. That way you can confirm that you have very clear and concise communication. It's important in all relationships, also important in government. If the intelligence community is going to communicate an idea to Joe Biden to say, Hey, Joe, if you leave the country in this manner, it's going to be a catastrophe for you. And Joe Biden says, so what you're saying is everything's going to be perfect if we leave. Right. And the intelligence community must have said, yeah, that's exactly what we said. Or the white house just didn't confirm that they did no , no . Be back to aid communication. And so now the white house is sort of saying, well, look, the , the general consensus was this. Or we get a lot of cables. And so we, our conclusion was X, Y and Z. The intelligence community is saying, it's the opposite. The us allies are confirming differently. Now we have Adam Schiff that is getting a direct report from the intelligence people. And so he's responding, saying like , it's , we're not getting everybody out of there by August 31st. What are you nuts? The white house is not saying whether they're going to be able to do that. And they're equivocating about what happens if they don't get it done past August 31st. And so I think you can come to the consensus that the white house is hiding the ball. The evidence here seems to show that it's not going to get out. Americans are all not going to be out of there by August 31st. If it was possible, I think the white house would be unequivocal about it. Yeah, we're going to , to get it done. No problem, but they are not. That's why they can't be definitive. Now. It is things are getting even more complicated because ISIS is now back in the fray. We are going to see season two of ISIS. We're in season two of COVID and people aren't scared to death enough already. So they need to introduce a new evil enemy again. And , uh , ISIS is going to be back out to play. Speaker 2Well, first I would say we have a stringent vetting process, which includes a background checks before any individual comes to the United States. Uh, so I can't speak to one individual, but I can tell you and, and confirm for you that we take the vetting of any individual who comes to the United States and comes out incredibly seriously. Um , and it's an extensive process. Uh , I would say that this is now on track Peter to be the largest airlift and us history. Uh, so, and that is , uh, bringing American citizens out. It is bringing our Afghan partners out. It is bringing allies out. Uh, so no, I would not say that. Is that anything but a success?

It's pretty impressive that she's able to come out here every day and just like, literally say things that aren't real, she's telling us, this is the biggest airlift in history. And so you just want to pat each other on the back and just sing kumbaya about how great the job you're doing, even though it's not going so well. So she's very appreciative of the fact that that's the biggest airlift in history. They're going to get everybody out of there, but not , yeah , really. It's nothing about a success. So we'll see how that goes. It shows up in the poll numbers are , they're not doing so good. Uh , the media very, very unhappy about this. And then they're saying that , uh, the troops have already started to leave. Started today, written by CNN or in Lieberman's had first us troops have already started leaving Afghanistan. This is the final week of the efforts at this point only a few hundred troops have left out of the total 5,800 they're in cobbles airport. The evacuation mission remains the focus. We have a quote here. It says so far, the reduction does not affect the mission said, one of the officials said that the decision can be based on a few factors, including the number of gates open at the airport and the number of people coming through. And more, if you can have a smaller mission set and still conduct the mission, then you can reduce your footprint and reduce your risk. So again, it's sort of, you know, who's the last person out the door, they got to turn the lights out and it's not real good situation there . Uh, NBC news is saying that R D the usual suspects are very unhappy. The war is ending fury and discussed over at the CIA, the Pentagon and in Congress because thousands of Afghans are going to be left behind with president Joe Biden, going to be sticking to August 31 deadline coming clear that thousands of Afghans who help the U S are not going to be evacuated scenario that has engender deep frustration in the U S national security agencies set a former us intelligence official , of course, this person declined to be quoted by name, which is usually just say it use your name. If you want. He said, he grew nauseated and he considered how many Afghan allies would be left. Behind, said, people are furious and disgusted at the CIA officers feel a real sense of obligation, a moral obligation and a personal obligation to the Afghans. They supported said former CIA director, John Brennan, who's an idiot , uh , on NBC national news security consultant. Yeah, he's the same guy who said that libertarians and people who are anti-government are terrorists and they're domestic terrorists that need to be monitored and stuff. So , uh, that guy doesn't know anything other than big military, big law enforcement wants totalitarian control over basically every facet of everything. And so it doesn't surprise me for a minute that he is upset that we're no longer in Afghanistan. That's actually a very good reason to make sure we leave Afghanistan. If John Brennan is somebody who says that the CIA is upset about us leaving Afghanistan, it's a good reason to get out of there. Well done there , Joe Biden. So you can split that a couple of different ways , right? Joe Biden is really sticking to his decision to leave, which is commendable. Now, the question of course is how do you weigh that against the final result? Right? The scores is not the game's not over yet. It's about to be over here real soon. And if there are thousands of Americans, hundreds of Americans, even tens of Americans who were stranded over there, that U S government left there, that's a huge, huge problem. Right? So please stop with the guilt trip that we let them down. So many people in my life helped me in big and small ways. Many occasions. I say to myself that one day I will reciprocate that help, but I know, and you know, it's not possible. It's best if we can help back, but the circumstances won't let us, we move on and try to help someone else who needs help. We pay it forward, help us help. You're not required to repay it. It should be given with no strings attached stop with the guilt trip. A lot of people are in dire situations that need help too. I pray for Afghanistan. I hope they get through this. Yeah. I mean, we're, we're, we're putting ourselves as people, as external observers who are watching all of this in a, in a difficult position, because now you'd have to start measuring lives. Don't you an American life versus an Afghanistan life versus an Afghanistan person who helped the U S versus an Afghanistan man who helped the U S versus an Afghanistan woman and child who did not help the U S but who are going to be killed by all of these different complexities. And so the U S government now is in the unenviable position of saying, you get to live, you get to stay, or you get to go, you get to stay. It doesn't necessarily mean you're going to die. But if you're a former Afghan, official odds are not looking so good for you, which makes it a difficult thing to talk about. But I think that there is a limiting principle that is relevant by Mullican . We only have so much capacity to help, same arguments that you make at the border. Yeah. There are thousands of people who would love to be here in America, and they would love to come and be a part of this. And I would love if they could come be a part of it. That's not what we're talking about. The U S government doesn't even have the capacity to keep the lights on in some parts of this country, or keep the electricity flowing, or keep the water clean, or keep the budget balanced. Or even when wars can't even do that anymore. So the U S government is not in the capacity to help everybody who needs help. That's the, that's the concept here. The U S government doesn't have the capacity to go build another foreign nation. They're not good at it. Didn't work out. How about we stop trying to help everybody and encourage and incentivize people to help themselves and do well in their own countries so that they don't have to fleet. The dumpster fires of their lands would be a better way to do it. But you see the argument. It's, it's the bleeding heart. It's whole . We want to help everybody. We can, we can, we can do better. We're human beings. And it's now suddenly every single problem in the world is everybody's problem in the world. And that's not really realistic. It doesn't work that way. If you try to, you know , create public policy on that foundation, it's not going to work out, look, what's happening. We got John don't vote for Kinzinger. How green is here. It says that Kinzinger poses the , uh , I'm kissing up to the Democrats, hoping they don't redistrict me out of a job because I've completely lost my mind. And I forgotten. He sort of, you know, bringing people over using congressional resources. And so you're going to continue to see this in the aftermath. This is going to be part of the big problem that I was talking about yesterday. This sort of death by a thousand cuts. Yeah. They might get the meat and potatoes of the Afghanistan war they're all over. They might've , you know, shoved all that down their gullets, but they're going to have to feast on a slow drip over the next three years of horror stories coming out of Afghanistan and everybody , every time that happens, especially if it involves an Afghan who was a loyal ally or if it was an American citizen, every one of those stories for the X 39 months is going to be connected back to Joe Biden. And it's the same thing they did with Donald Trump every day, more deaths, more deaths, more tests , more deaths every day for Joe, it's going to be more deaths, more deaths, more deaths because the media loves that. They love those ratings. They love ISIS. They love terrorism. They love making sure that the big security apparatus, the intelligence community can just, it can just strip away your liberties and you're free to , and your rights and as long as they're moving that direction and as long as they can get out there and talk every day on CNN, about more fear and more incompetence and more , uh, more stuff that makes the everyday American just sort of recoil. I think the better it gives them good ratings and it supports their , uh, ideology of never ending government power. All right. What else do we have? We have some other questions here. It's quite obvious that the whole situation in Afghanistan was orchestrated as a monetary grift of the American taxpayers' money by the military industrial complex. But I wonder how this compares to how people would fair standing up to the native authoritarianism here at home. Yeah. It's much easier for people to get outraged about what they see overseas, because that's happening to other people it's happening in other parts of the world. But when they look around their own lives and they say, well, a lot of these things are kind of happening here, like limitations on your free speech or property rights , uh, who is in control of what happens to your children in the schools. All sorts of things are changing here locally. And it certainly feels like authoritarianism to me, but you'll notice if you talk to some people about it, they just, they, they, they want to do the ostrich defense defense, which is just sticking your head right in the sand and just saying, well, you know, it's still pretty good here and it's it's necessary. It's just, COVID, you know, it's just temporary. And all this stuff is just this fleeting. So don't worry about it. Well, we said that 18 in months ago with the 15 days to slow the spread and look where we're at now, it's the slow frog. It's a slow boil of the frog in the pot, and it's not going anywhere. Uh, V bittersweet latest poll has Biden at 41. Yeah. And it's probably going to just keep tumbling from there, although that's pretty dang low. Ms . People would be charged with crimes. Look, if you, if you steal some tax money, you get charged with crimes for that. If you, if you sell somebody drugs and you go buy a car with that, well, what do they do? They take that car cause you purchase it with the illegal earnings. Meanwhile, mothers, fathers, sisters, brothers, they all have dead relatives as a result of this. And there are people who are swimming in their swimming pools, living off of the government war money that came from your and I's pockets all for nothing. Yeah. All right, we've got a next segment. Got to move on and we're gonna be talking about COVID. Now we're changing gears, talking COVID stuff. Los Angeles. One of the biggest cities, if not the biggest city in the country is now on the verge of mandating vaccinations for all of their city workers. We've been seeing this sort of spray around the entire country, like a series of dominoes, just cascading all over us. As we just sit here and sort of watching fear as the government continues to tell you what you can do, where you can go, who you can see and what now you can put in your body. So the LA now, according to the New York times passed on Wednesday, a COVID-19 vaccine mandate. This is from the city council, 60,000 city workers, including police officers and firefighters are now going to be mandated to get the vaccine does not include an option for regular testing. So the grip of these tyrants are just slowly, slowly increasing every single day. You see how that works and now LA is going to be doing it in other cities. You've seen these exceptions, religious exception, medical exception, any other just, I don't want to take it exception. They provide for regular testing. LA doesn't say that no more regular testing exclusions here. Other major cities, states companies, healthcare systems, and the federal government had passed different VAX rules, but many including New York allow people to skip the shots. As long as they're regularly tested LA though . And one recently announced for Seattle removes that option LA will only allow medical or religious exemptions. So get it or don't. And if you look at some of the religious exemptions or some of the medical exemptions, what you'll see specifically for the religious exemptions are a lot of, a lot of ways to make sure that you don't get that exemption. One of the ways they do that is they say, well, what's your religious exemption? And you say, well , uh , it's against my religion to take , uh , put anything in my body and they'll say, well, have you ever put anything in your body? Have you had any surgeries? Had you take over the counter medicine, do you ha do you have prescription medication? Do you , are you on blood pressure medication? Are you on antidepressants? They ask you all of those questions so that they can identify whether or not it's a genuine religious belief. Cause if you say, well, I , I mean I had a surgery and they gave me some , um, some medication to make sure I go under, well, certainly sounds like you took something in your body, doesn't it? So since you did that, why don't you just take this COVID jab on top of it. And so these forms were looking to be very cumbersome and they're very, you know, very full so that they can find a way to make sure that you don't get the exemption. The vaccine mandate ordinance out of LA. It still needs to be signed by the mayor in order to come LA , but press secretary said on Thursday that the mayor would sign it soon. Once it's signed, city, employees are going to have until October 19th to be completely vaccinated against the virus. Uh, this has completely inoculated against the virus, but that's not actually accurate, right? Uh, we need to do everything in our power said Garcetti to protect the health and the safety of those who keep our city running. And you notice it said, city firefighters, we're going to get there, said Angelenos rely on the services they provide every day. Like for example, putting out fires Garcetti said in his statement, this requirement is the surest way to achieve that. So he says that what he wants to do is mandate that their employees get the vaccines so that they can continue to provide services in order to keep our city running, see how that works, get the jab so that you can continue to work so that the city can continue to function. The ordinance does not yet specify penalties for workers who don't comply said the city was negotiating with many different unions that represent the workers, but said that she hoped it would not involve the possibility of firing workers who do not comply. So the unions are up in arms over this because their employees don't want to get them, right. They don't want to get the vaccinations. And so , uh, they have a lot of bargaining power. Cities are just steamrolling over the unions anyways and saying, well, we don't care. Right? And a lot of these are between different Democrats. You have these warring democratic factions, the pro vaxxers, Gar settees who want the jab and everybody's arm. You've got the unions who are big, big democratic entities who fund all of the liberals who are now saying, yeah, but our , our people don't necessarily want those. And so you've got this contradiction, this, this , uh , problem between these two entities. And we'll see where it goes. Now I talked about this yesterday on the show saying that I , I read a headline that there was a , we're starting to see what happens when you start to weaponize and politicize economics. When you politicize a private enterprise, right? In this case, or even public enterprise, we're talking about doctors, we're talking about police, firefighters, nurses, surgeons, all of these different people. If they're going to start getting involved in providing services based on political ideology. Well, we're going to see some very interesting things happen in this country. What if you go to a restaurant and they say , uh , well, did you vote for Trump? You say, well, I guess I did well, then I'm not serving you. Okay. What if you go to a , you know, get your tires changed and they ha and they say, well, at this tire shop, it's only libertarians here. We only P we , you know, we , we don't believe in the , uh, in the U S government or whatever. And so every single , uh , an entity that you visit now is politicized and weaponized, which is where this is going. We've already seen this with the NBA, the NFL, what used to be sort of a nice Sunday of watching sports is now this woke politicized nonsense that nobody watches anymore. And so we're seeing that happen. We saw this yesterday out of Florida, we've got south Florida hospitals. They staged a symbolic walkout yesterday. I didn't see it was symbolic. I just heard it was a walkout. And so they're saying that the , you know, basically we're not look, th th the headline that I saw yesterday was that they're not going to treat people who are unvaccinated . It's a symbolic walkout , you know, we're walking out and we're not going to treat the [inaudible] . They wanted to draw attention to the surge in unvaccinated patients. So you've got these knuckleheads out here who are just saying, okay, right. Basically we're doctors, you know, the , the implied threat there is, we're only going to treat people who get the backs . And so I said, okay, that's fine. You know , let him do that because you're , you're going to see people going the other direction. You're going to see firefighters and police officers and construction workers and welders, and people who dig the ditches and serve the food and grow the food who don't want to play this woke game, who don't want to go out here and do these stupid symbolic spectacles, where they get everybody together in their paper, maths , and they go outside and they do this virtue signaling in front of everybody. Look how virtuous we are. Look at our morality. We're going to stand here and hold our hand side, decide in our, in our stupid white coats , uh, and, and, you know, play doctor or whatever with our masks on. And we're going to go out there and do this symbolic thing in front of the news with this dumb podium. And we're going to scold everybody for not getting the shot, and they're going to pat themselves on the back. And they're all going to go back in there and say, wow , we're doing a great job. They probably have a Facebook group and group text messages. And they're probably really thrilled about their, their, their moral stand. Okay, good for them. But if they're going to do it, it's going to go both ways. If these doctors are going to go out there and make implied threats, that they're not going to come and save your son or daughter, because they made a medical decision between their men and their doctor to not get the vaccine. Well , two can play that game and it's going to start. It's already starting right now. I want to introduce you to this guy. His name is Christian [inaudible] . This is a Los Angeles fire department, captain, captain of the LAFD, the Los Angeles fire department. He's not happy about the vaccination vaccine requirement, and this is prompting an internal investigation. So this guy spoke out about it. He's wearing an LA fire department hat, and t-shirt he glares into the camera. We're going to see this next. And he says, I'm done being silent about this matter. It's a rare, rare public outburst by a member of the fire department against the COVID requirement that is coming out of Garcetti's office. GRA Noochie accused the fire union of being quote in lockstep with total tyranny said that the firefighters have retained an attorney called them . A sharp says, this is about, this is not about being vaccinated versus unvaccinated. He says, this is about freedom of choice. Why don't you reduce you to this guy? His name is Christian GRA Nucci. And this is just probably one in , in , in , in a long series of other dominoes that we're going to see. This is a man who is 31 years as a firefighter saving lives, who is now being mandated to do something he doesn't want to do. Let's see what he has to say about it.

We saw it coming across the Pacific in a week and a half ago. It landed in Honolulu with the Honolulu fire department. And we watched a passionate plea from captain Pelicano literally in tears being forced to resign because he chose not to take the vaccine. Wow.
Speaker 1All right . So you see what's happening, right? And this is a captain 31 years. He's saying that another chief, also another captain or another one , or whatever he said is also just resigning. Not going to do it, not going to take it. Thanks, but no, thanks. And I'm outta here. And, you know, folks, this has happened a lot during last year with the summer of unrest, everybody came out and wanted to beat the F the police up scream at them. You're responsible for all of the racial animosity that exists in this country. We're going to blame you, Derek Shovan for all of the ills that America has bungled up over the last 200 something years, your fault. That's what happened. The police said, no one is knots and they left and they're going to continue to leave. And they should, because they're not being appreciated. That's coming from a defense lawyer. So it's a strange world that we're living in where now you're telling good people to just stop being public servants anymore because the public is under appreciating them. The public has been taking advantage or taking for granted good men like this who have been serving their communities for 31 years. And you have some moron, like Arcedi who just comes out and says, well, you know, I'm smarter than you. I'm smarter than all of the individual people who can make decisions for themselves. I'm going to tell you how you live your life. And then you are going to do what I say. People are going to say , no , no, we're not. We're not going to do it. And this guy is going to be in a, in a hard moment for the foreseeable future, as we're going to talk about. But as the world continues to self sort and self-select, and all of the vaccines , people who want to go, you know , vacs people, things they can go do that they can live in their bubble wraps . They can wrap cellophane around their face if I want, if they want to, for all I care, but they're going to have to live in that world. People like this, there are going to be other jobs for this gentlemen in other societies that value freedom and don't value mandates. And it's going to take maybe two decades until the sorting is finished, but that's where it's going to go. And it's actually going to be a better freer , more optimistic America. And I'm looking forward to it. This is unacceptable. This guy's right for speaking out, let's listen to him . He had another statement here where he tells you what he thinks. He knew that if you watch the full video, there's actually a funny part in that. He's very upset about it. You can see it in his face. You can see it in his eyes 31 years. And now he's going to have to make a hard decision here. And he said, in the video, I'm going to get in trouble over this. He says, well , when my wife finds out and you see him sort of connect the dots , he goes to Susan, my wife, she's going to kill me. And you have some empathy for the man. He's got a family, he's got a wife. He's making a hard decision here. And the other people just say, oh , it's just a shot. Just go get it. No, it's not that simple. Alright . So LA of course, they're unhappy about it. The fire department said in a statement that the matter has been submitted over to professional standards division for investigation may result in disciplinary action. They say, well, while we respect an individual's right, to an opinion, you know, he's not authorized to speak on behalf of the department. He's in his uniform, appears to be on duty. He's there by giving the oppression . He's speaking in an official capacity. So Greg , Nuci's 50 to talk to the firefighters and their family. They're worried they're going to lose their jobs. If they don't get it, Teddy doesn't object to others, getting the shot. Alex Komisar spokesman for Garcetti said the requirement is to protect the health and the safety of our workforce and the broader public. But if you recall what Garcetti said at the first outing was get the jab so that you could beat the virus. So you could provide services. Well, guess what? He's not going to be providing services anymore. And that's your entire job essentially, is to run the government and not doing such a good job of that. All right . Humanly possible, including essential services. The feds are not going to be able to do it, but the , uh, the local cities will, and they'll be able to do it with a lot of, 'em a lot of sticks, right? Carrots and sticks in order to get people to , to comply with this. So one might be, you know, we're not going to mandate it, that you get it, but in order to do most anything, you have to get it. This is the model that we see out of New York city, right? So it's gonna be very difficult for them to mandate that you go get this in any circumstance, no matter what they have to attach it to something else, they got to attach it to employment, public safety. They've got to connect it to do , you know, some, some other basics that the government has for requiring you to do something so dramatic. And so in this case, I think that as soon as the, they are rolled out, they're going to be here to stay. And essential services are probably going to be, you know, required to get it. I think they already are in New York and LA and elsewhere. It's everybody. It's , it's everybody. There's no essential services. And non-essential , it's everybody. If you work for the government, you've got to get it. That was okay. So let's go over here. Pick a couple of, I got to skip ahead now. All right. We got wants to know, says, could companies or governments that need workers just take these [inaudible] workers. How are they going to hire replacements that are Vaxxed ? Well, I , yeah. I mean, there's already worker shortages all over the place, all over the place. So if you're now a vaccine entity and you can't find workers, I don't know. I, I , it's gonna a very, very catastrophic ripple effect that man is not going to be alone. Thunder seven says just don't board. The trains don't get on the trains. We have eat. Won't flush, eat. Won't flush is here, says, will they start vaccinating the homeless? It's a good question. And I think why not right? Judges are already mandating it for criminal defendants. Why don't they just mandate it for the homeless people as well? It's not your body anymore. Folks. It's the government's Paula MK says, just found out today that my job is mandating the vaccine. Not sure what I'm going to do. Here's to hoping that all that free money for unemployment will still be available. So while they might attach the VAX to unemployment, at some point, there are so many hospital workers for our health system that refuse to get it. So I'm just waiting for the fallout. The first thing is, did you see this N Y post article about masks and 95 mass, more effective than surgical masks ? It says just to be a , you know , kind of a punk to the general populace . This is one of the times in my life. I'm going to pat myself on the back for having my guesstimation calculations for her from a however many months ago, come out closely to the numbers in this article. And that was an article from the New York post where , uh, they , they were, you know , saying this study finds in 95 mass, more effective than surgical or cloth coverings for the face masks. And so I think we've seen a lot of that come out. He says also how come there's no scientific exemption outside of the medical ones? One thing I've learned more than anything from my years in science is that people lie, actually, even though that's true, it's not what I learned. When you study enough engineering, you learn that there are times to fix things. There are times to get new ones. When you study math, you learn that not everything is provable. When you study the law, you learn that there are times when all the adversaries are justified. When you study enough science, you learn that nothing is for certain, except for the limitations on humans to observe and calculate all the factors. I think there's a lot of truth to that. There's a , a gentleman by the name of Nicholas and the scene to lab wrote a book called the black Swan. And the premise there is that human beings really think that we're pretty intelligent. We're pretty smart. We can , uh , measure things. We can create models. We can tell you what the stock market's going to do. We can measure the weather. We can , uh , really sort of model our futures. And basically what he says is that in a lot of those situations, totally wrong can't model. Anything think you can, but you can't. And that history is full of what he calls black swans, which are these things that pop up and that everybody tries to wrap their head around and they can't because it's not possible to do it. Human beings have a lot of flaws in our perception. We don't think in logic and reason, all that. Well, we think we do. We create models and spreadsheets and charts. And we go on the news and we say on Dr. Fowchee, and here's what I've been studying for the last 20 years. And so this is how it's going to happen and guess what wrong, wrong, wrong, wrong, wrong, wrong. Every single month. It's been like for the last 18 months because human beings like to create our little worlds , our little mindsets that make us feel safe. Oh yeah. We have officials in charge of this. They know how the government runs. They know what interest rates are appropriate. They know all the different markets and how they all work. But guess what? They don't, it's all a big fiction. They're all just sort of bumbling through the universe as best they can. And that's really what it comes down to. Uh , the rest of it's all just a show. We have a Sergeant , Bob says, cities have a hard time recruiting police, fire, EMS. It must not bother LA to potentially lose some of their ranks less services on the way that's from Sergeant Bob, who is a Sergeant, former Sergeant. So , uh , he knows what he's talking about. I think the long and short of it is, yeah, they are already extending the vaccine passports to all services in New York city. It is everything. It's not essential services it's , uh , or , or just non essential services. It's basically everything, including even some grocery stores. All right. We got Paula MK says glad to see firefighters standing up for freedom. There is a bravery, first responders required to do their jobs. It takes a different kind of bravery to stand up to tyranny. Hoping there are more like him. Oh , me too . Uh , I think that we are going to see many more people like that. One Florida man says it is a fantasy to believe that everyone will be fully vaccinated with boosters with no adverse events. Realistically, how many years of three jabs Americans except flu vaccine is only once a year. And most Americans scoff at that. That's from that one, Florida man. It's a good observation. I think even bill Maher made that comment on the last HBO, whatever he did, whatever that show is called. He said something like, no, I'm not going to get it. I got the jabs because I took one for the team is what he said, but I'm not going to keep putting that stuff in my body. And he's a kind of a , a mainstream lefty. So maybe a lot of people feel that way. We'll see how it goes. D is here, says this may be a tad sing cynical, but do you think we could get to a point that the doctors who were opposed to unvaccinated patients may not always use every possible means to save those patients when they are hospitalized, it would certainly bolster their stats that they are already claiming that all of the people dying in the COVID are UN vaccinated. Oh yeah. Right. You start to ask yourselves, are people sort of a more inclined to help ? Look, let's say you're a hospital and you can't come out and say, no, we're not going to take the, the , uh, the [inaudible] because you swore an oath that you're going to provide medical services to the sick. Doesn't matter if it's a black, sick person, a gay sick person on old sick person or a young sick person, you're going to treat the sick. And so you can't discriminate based on vaccination status. Can you not on the face of it, but maybe once they come into the hospital, you say, oh, this guy's on Vaxxed . Well, just , uh , I'll get , I'll get back to his room when I get back to his room, because you've got people who are so mentally diluted that that's how they are now orienting themselves in the world. Chairman of the board is back live. And we're grateful for that. He said was that dude, clearly it doesn't need a vaccine. If he gets COVID, he'll just order it out of his body and it will go. But seriously, what next will they mandate not smoking, eating and nutritional habits, driving habits, dangerous hobbies. Where does it end? Yeah. Maybe your sex habits too. Right? What's your read what you'll look at. A lot of that stuff is pretty dangerous. You know, you put a big Mac in your mouth. That's, that's kind of a problem for your general health. We got three girly says, so all city employees, these need to have the COVID back. That means that people like street sweepers, even the garbage men , garbage Manor , janitors are more susceptible to bloodborne pathogens . They aren't mandated to get vaccine against things like hepatitis or HIV. Hell , I would be shocked if they were mandated to have the technician. Yeah. But these guys have the COVID shot to pick up the garbage and sweep the streets. That's from three girlies . It's not a B . You're exactly right. It's not about saving lives. It's not about the vaccine. In my opinion, it's about mandating it. It's about social proof. It's about Eric , you know , wanting to win his next primary. And that's what this is all about. So saying that there was something in the vaccine, in the vaccine that came from something that is , uh , that is prohibited religiously or that the process of creating the vaccine itself was used was, was done in a manner that violated your religious principles. Is this a medical bear ? A plastic barrier is that sufficient. And we sort of went through some different scenarios and saw whether or not they would be okay under the vacs pass and hard to tell. So I think it's, it's anybody's guess as to what New York is doing, it sort of is all dependent upon their little, you know, reporters, the people who go and investigate. Are you wearing, are you vaccinated? Are you vaccinated? Are you checking for vaccines? Right. Those little mini dictators are now going to be able to go and enforce those rules. And so you have to now bow to them. Oh, oh, you're de Blasio's little enforcer. Yeah. I'm checking vaccines. Get out of my way business. So , uh , that's how it's going to go. Great questions. Michael Abinadi lives to see another day. This guy has more lives than the nine lives that a cat has. And he kind of is , uh , excited about it. A mistrial was declared in Michael Abinadi, California embezzlements case. So federal prosecutors were , uh , prosecuting him for embezzling, California. Judge declared a mistrial on Tuesday, said that he was charged with stealing millions in settlement money from his clients. The judge who came out in rural this, her name is judge his name. Judge James [inaudible] ruled on technical grounds said that prosecutors failed to turn over relevant evidence to Abinadi. We're going to take a look at the motion to dismiss. The trial was originally scheduled for , uh , October. It looks like October 12th. It's when it's going to be, we have a new hearing date. I'm sorry. Yeah. So, so they already scheduled a tentative new trial date. That case is set for oral arguments or another hearing on September 2nd. It was the second trial in recent months, 50 year old lawyer once represented stormy Daniels in her lawsuit against Donald Trump was sentenced to two and a half years in prisons for a $25 million extortion case that was out of New York. And so remember he lost that trial , uh, two and a half years in prison. We talked about that briefly and he got called into court in LA, in California over embezzlement. And so , uh , take a look at this motion to dismiss or to ask for a mistrial. So he filed this on his own. It says that he is filing this , uh , Michael Abinadi pro se. It means he's representing himself put together a very big motion, 45 pages. So presumably he wrote, this says defendant's motion to dismiss or in the alternative to ask for a mistrial why the government failed to provide Brady information and also saying that basically they should be held in contempt of court. So let's see what's going on here. Michael Abinadi brings forward the motion to dismiss and here is the table of contents. We got an introduction, factual background. What we're really talking about here is this evidence, QuickBooks data and tabs data, both of these are different pieces of software. And so basically what this is all talking about is discovery, right? We've talked about this a lot in criminal cases. This is a very important point of any criminal case. We talk about this a lot that you can, you can win cases on discovery violations, which is essentially what Menotti did here, right? He didn't, he didn't win the case, but the government was prosecuting him and they didn't get a conviction here. They got a mistrial, which is not good for them, right? They're supposed to win their cases. So this was a victory for ABA naughty . Now it's about discovery. Remember when you're charged with a crime, the government has all of the evidence against you. It's in their possession. They have the body cameras. It's the police. They have the 9 1, 1 calls. They have all of the witness statements. They have everything. And so if you're a defendant and you need to represent yourself, or you have a lawyer, you gotta make sure you know what they have so that you can prepare your defense against it because they hold all the cards. And the , and the law says that that field needs to be evened up a little bit. So in this case, they're talking about QuickBooks, which is a financial software and about a lot of financial data, not that interesting, but we can see how this worked throughout the trial. Even before trial says, Abinadi a central theme of the defense has been talking about attorney's fees, talking about money and saying, the government here has to show beyond a reasonable doubt that he was not entitled to that money. It was embezzlement. And so at the beginning of the trial, Abinadi during his opening arguments talked about this calculation. He wrote this on a flip chart, a flip chart is one of those big, ah , like a big sticky note. So he goes out there, writes calculation at the top of it. He focused and that's the theme of his trial. So he focuses on this theme, brings it out, numerous government witnesses come out, they all go through it. They're talking about fees and costs and they're being deducted from the client's settlement. So we have a total settlement. Abinadi represents somebody, they win 10 million bucks, his fees, 33% or whatever it is. And so they're doing this calculation about taking those fees, what the, what the prosecutors are saying, no, he took too much of that money, took too much of those fees. That was the embezzlement. He was not entitled to that money. And so what we're talking about here now is whether he had the evidence he needed to prepare his defense, his office manager, woman named Judy Regina testified for the government. And when she was testifying in court, she talked about two different accounting, software programs, QuickBooks and tabs, both were maintained. And the government apparently had access to some of this stuff before trial. The government produced one version of the QuickBooks data that was in discovery, but they don't really know where it came from or whether it even was the most recent version that was kept by the law firm file. Also had a blog, a lot of problems, authentication problems, foundational problems probably explains why it was not entered into evidence or even found to be admissible. So the government comes out and they say, yeah, we have your , your financial records. Uh , we're going to give those over to you. It's one copy. It's a huge problem. There's no way there's authentication foundational problems. Don't even know if it's the most recent. So how can you calculate what portion of the money was embezzled? If the accounting software is inaccurate, it's not so good. As for tabs, the government, which is different software, the government never produced the data of an Audi , never even given access to the tabs data made requests. And he said, it's very clearly relevant. He's absolutely right. Abinadi raised the issue back in August said, your honor, I'm preparing for the testimony today became apparent to me. The government has not produced the tabs data. I need that. It's a serious Brady and giggly O violation. If I'm wrong. And it has been produced. I want to know where it is. The government did not respond. Abinadi again, requested the government, provide the information, says, where is the tabs data? I just need the Bates stamp number. Didn't argue the point, right? He's talking about what happened in the trial. The government comes out and the court says, government, does the government have the tabs data rather than provide a yes or a no answer? Assistant us attorney. Saygall said a quote with regard to tabs. I don't know where if it even exists and so forth, I don't know about the extractions. We don't have anything in our database, separate of tabs and so forth. He said, and this is a direct quote from the trial. As demonstrated below the government has been in possession of the tabs data and other QuickBooks data, including more corn , current versions that were all seized from the firm in 2000, 19 two and a half years ago. But they failed to produce this critical, highly relevant information. Despite all the rules ordered it or the court ordered it as well. For over two years, they represented the court that the defense that no financial information had been withheld. The government said, we gave you everything we have. They didn't, they didn't at all, even worse. Despite the trial testimony and the importance of the data, the government continues to refuse to produce the data. The government suppresses material information failed to produce it for a year despite its obvious import and their clear obligation to do so. As of this filing their failures continue, the government misconduct is inexcusable and it's outrageous. It violates Mr. Abinadi, his due process rights interferes with the ability to defend themselves. The court should declare a mistrial and they did Megan Conniff over on Twitter reported what happened said. So the question now is what is the remedy? We know that there was a discovery problem. We know that there was a violation that the government had the data they should have given it over. They didn't. So now what, what do we do ? I knew about this selling this as it's not, that's not going to address the problem. Oops. That's not going to address the problem. And it would have to be a very long to give the time to review the material so that they're not going to hold the jury like that. So basically what they're saying is we're not going to allow this to just kind of continue on. And so they said, shortcomings may have been there, but it wasn't intentional. It wasn't malicious for those reasons. I'm just going to grant a new trial. In other words, the court is saying, yeah, the prosecutor is screwed up here, but they didn't do it intentionally. And so we're not going to penalize them by dismissing the case. We are going to penalize them by making them do this all over again. And so , uh , one take on this from Twitter says this was a significant misstep in the prosecution. It's going to result in a second criminal trial. But even though I haven't not , he bought himself some time. The prosecution can now improve their case for the next trial. So we'll see if they do that. The next go round. Let's take a couple of quick questions. Just a few before I have to get out of here. We got misled. You know those , uh , Hey , miss lucky. It says, why don't they mandate healthy lifestyles to build immunity? That's a good question. I would, I would think that that would be very appropriate, but nobody cares. Cause it's it's about control. Not, not about , uh, boosting your immune system or living a healthy life. We have Mustang. Jeff says Abinadi is a CNN fade . How soon before he's on TV saying he's being persecuted by the government. Oh, well that's only if the Republicans are back in charge because a he's a pretty big Democrat. Isn't he? I think he's going to go to prison for some time. We have just an abscess . Sorry, Robert. I know attorneys like Michael, Abinadi give your profession a bad name. I know they do. And they, you know, I don't, I don't like it. When attorneys do that, I like to call out bad Popo. I like to call out bad lawyers as well. I have a naughty in this case, we don't know yet. Right? I I'm a big believer in the presumption of innocence, but the guy's kind of a , you know , less than admirable in many different ways. And so, so we'll see where this goes. That being said, look an enemy of an enemy . He is a friend, right? In many cases, and I'm not calling the U prosecutor's office enemies, but they do hide evidence all the time. They pull this type of crap all the time and it's not appropriate or not . He's entitled to his defense. He's entitled to due process and the presumption of innocence, just like anybody else's. And if the us government's going to hide evidence that he needs to defend himself, not appropriate at all. We've got a couple more super chats here. Let's see what this one is. Oh, this is from local says, do you think this was a deliberate error to save the great Abinadi who was going to save the world from the orange man? Bad. Probably not. I think that this is just typical prosecutor nonsense, and they just got caught in it. They kind of screwed up a little bit. Wolfgang says, why do we need vaccine mandates? If they were right, then they would let us decide and discuss amongst ourselves instead of forcing it. Now it's about freedom. I think, I think that's sort of the big takeaway here is , um , I don't have any problems with the vaccines. Get five of them if you want. I don't care. The problem is about the government. This is now mandatory. You had these liberties, you had the choice before you don't anymore. And we're going to make sure that you are precluded from doing a bunch of other very important things that you used to be able to do. If you don't do what we say, that's the problem. And so that's where we take issue with it. We're going to continue to do that until I guess we can't anymore or until we win, which I think we will.
